The subject of the order is the modernisation of the Next Generation Firewall type Border Security System with Sandbox function and EDR system of the company Check Point. The description of the subject of the order, hereinafter referred to as “OPZ”, was presented in Annex No. 1 to SWZ and in Annex No. 2 to SWZ - Draft Contract Terms, hereinafter referred to as “PPU”. The ordering party requires that the offered service, including all ICT products, ICT services and ICT processes used to implement the order, whether as main elements, components, environmental elements, service provisions or complementary solutions, does not include: • ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of the security of the state; • an ICT product, the type of which was determined in a decision on recognising the supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement results in the rejection of the offer accordingly on the basis of Article 226(1)(17) or (19) of the Pzp Act. To confirm the above, the Contractor, together with the offer, is obliged to submit a List of ICT elements, which is Annex No. 3A to SWZ. The List is an integral part of the offer and serves to identify the ICT products, ICT services and ICT processes covered by the offer or used to implement the order.
