The subject of the contract is defined in Section IV of the SWZ and in the contract project. The CONTRACTOR DOES NOT ANTICIPATE THE AWARD OF CONTRACTS, AS REFERRED TO IN ART. 214(1)(8) OF THE PZP ACT. The INFORMATIONAL CLAUSE RESULTING FROM THE GDPR, WHICH FULFILS THE INFORMATIONAL OBLIGATION TOWARDS THE CONTRACTOR RELATED TO THE APPLICATION FOR AWARD OF A PUBLIC CONTRACT, has been included in Section VI of the SWZ. The contractor applies the procedure specified in Article 139(1) and (2) of the PZP Act. First, it examines and evaluates the offers, and then it qualifies the contractor whose offer was the highest rated. Only this contractor is invited to submit the JEDZ, including the separate JEDZ of consortium members and entities providing resources, if applicable. Before selecting the most advantageous offer, it also invites the contractor, pursuant to Article 126(1) of the PZP Act, to submit the following subject-specific evidence, current as of the date of submission, within a period of no less than 10 days. Contract performance bond - 3% of the gross total price stated in the offer.
