The subject of the contract is the purchase of 2 units of excavator-loaders along with trailers for their transport, divided into parts. 2. The subject of the contract (SOC) is Annex 1.1, 1.2 to the SWZ: a) part 1 - delivery of 1 unit of excavator-loader along with a trailer for transport; b) part 2 - delivery of 1 unit of excavator-loader along with a trailer for transport; 3. The subject of the contract offered by the Contractor must meet all the requirements specified by the Purchaser in Annex 1.1, 1.2. 4. The Purchaser requires that the offered subject of the contract be factory new and compliant with all applicable standards and regulations. 5. The Purchaser allows the assignment of part of the contract to a Subcontractor. 6. The Purchaser requires the Contractor to indicate in the offer the parts of the contract, the execution of which will be entrusted to Subcontractors, and to provide the names of any potential Subcontractors, if known. 7. The contract will be realized on the basis of the terms specified in the template contracts, which are Annexes 8.1, 8.2 to this SWZ. 8. The possibility of changing the contract and the conditions for changing are included in Annex 8.1, 8.2 to the SWZ. 9. The Contractor may also submit an offer for all parts of the contract. The Purchaser allows, in accordance with art. 91 para. 1 of the Pzp Act, the submission of partial offers. An offer can be submitted in relation to one, two or three parts of the contract. The Purchaser does not limit the number of parts of the contract that can be awarded to one Contractor. Offers for each part of the contract will be examined and evaluated separately. 10. The Purchaser may invalidate the tender procedure before the deadline for submitting offers, if circumstances arise that make further conduct of the procedure unjustified. 11. The Purchaser informs that, in accordance with art. 257 of the PZP Act, it may invalidate the tender procedure, if the public funds, which the Purchaser intended to allocate to finance all or part of the contract, have not been granted. 12. The Purchaser requires security for proper performance of the contract. The security is provided before signing the contract.
