The subject of the Framework Agreement is the arrangement of the procedure for concluding individual purchase contracts (hereinafter „Purchase Contracts“ or individually „Purchase Contract“) for (i) the production and delivery of 80 units of dual-power electric units powered from fixed traction equipment of systems 3kV DC/25kV AC with a traction battery with a maximum operating speed of at least 160 km/h in catenary mode and at least 120 km/h in battery mode, fully capable of operation on railway tracks of 1 435 mm gauge on the territory of the Czech Republic (hereinafter „Units“ or individually „Unit“), including all permits, approvals, consents and registrations (the term „registration“ in this tender documentation means all registrations having a character similar to a permit, approval or consent), which are, according to the legislation valid as of the date of delivery of the respective Unit to the contracting authority, essential for the operation and use of the delivered Units and which will allow the contracting authority to operate and use the Units regularly and without restriction on the territory of the Czech Republic and further including the technical documentation pertaining to the respective Units in the scope set out in the Framework Agreement; and/or (ii) the delivery of spare parts and exchangeable components ( „exchangeable spare parts“); and/or contracts for repairs and maintenance of the delivered Units in the form of Full-Service (hereinafter „Full-Service Contract“).
