Poland – Architectural, engineering and planning services – "Wykonanie kompletnej dokumentacji projektowo-kosztorysowej dla planowanej przebudowy i adaptacji istniejącego budynku zlokalizowanego przy ul. Piotrkowskiej 258/260 w Łodzi”

The subject of the contract is "Execution of a complete, multi-disciplinary design and cost documentation along with full inter-disciplinary coordination for the planned reconstruction and adaptation of an existing building for the task entitled: Adaptation of the existing building located at Piotrkowska Street 258/260 in Łódź for administrative and office purposes, including site development." 1. The subject of the contract includes all the works necessary to prepare and conduct the public procurement procedure for construction works and to carry out the works in accordance with the applicable legal provisions. 2. The contracting authority does not allow for the submission of partial offers. 3. Pursuant to Article 95(1) of the Public Procurement Law (Pzp), the contracting authority requires that the contractor or subcontractor employs, under an employment contract, persons performing the tasks indicated by the contracting authority within the scope of the contract implementation, if the performance of these tasks involves performing work in the manner specified in Article 22(1) of the Labour Code of 26 June 1974 (Journal of Laws of 2025, item 277, as amended), i.e., persons performing design and coordination tasks, if performed under the conditions specified in Article 22(1) of the Labour Code. 4. The method of verifying the employment of the persons referred to in paragraph 6, the contracting authority's powers in the scope of controlling the fulfillment by the contractor or subcontractor of the requirements regarding the employment of these persons under an employment contract, as well as the sanctions for non-compliance with these requirements, have been specified in the draft provisions of the public procurement contract, constituting Annex No. 7 to the SWZ. 5. The contracting authority does not require a site visit or for the contractor to verify the documents necessary for the implementation of the contract, which are available at the contracting authority's premises. The contracting authority recommends that the contractor conduct a site visit of the object to which the subject of the contract relates, in order to familiarize themselves with its technical condition and the conditions affecting the preparation of the offer and the implementation of the contract. The site visit is optional, and its non-conducting does not constitute a basis for rejecting the offer or may not be a basis for claims against the contracting authority arising from the lack of knowledge of the conditions for the implementation of the contract. 6. Subcontracting: 1) The contractor may entrust the performance of part of the contract to a subcontractor (subcontractors). 2) The contracting authority requires, pursuant to Article 462(2) of the Pzp, that in the event of entrusting part of the contract to subcontractors, the contractor indicates in the offer the parts of the contract, the performance of which it intends to entrust to subcontractors and provides (if known at this stage) the names (companies) of these subcontractors.
