Belgium – Enteral feeds – Levering van enterale voedingen en toebehoren

This contract concerns the conclusion of a framework agreement for the supply of enteral nutrition, enteral nutrition pumps and related materials, medical nutrition, meal powder and accessories (EN-FIT syringes and containers). The duration of the agreement is 5 years (2 years with the possibility of extending 3 times for 1 year under the same conditions).

Occasional joint procurement: Pursuant to Article 48 of the law of 17 June 2016 on public procurement, the contracting authority AZ Sint-Maria Halle also acts on behalf of Revalidatieziekenhuis Inkendaal, Inkendaalstraat 1, 1602 Vlezenbeek. AZ Sint-Maria Halle is only active during the public procurement procedure and its task is to award a framework agreement to the tenderer who meets the conditions of the tender and has submitted the economically most advantageous tender. In this context, AZ Sint-Maria Halle will, among other things, handle the administrative processing and organisation during the award phase, the publication of the contract notice, the regularity check, the evaluation of the tenders and the final award of the contract. This means that, after the award of the contract, the contracting authorities will each individually, for their part, conclude a contract with the tenderer to whom the contract was awarded, taking into account the applicable rules on public procurement and the conditions of the tender. The contracting authorities are each fully responsible for the performance of the contract that they conclude with the tenderer to whom the contract was awarded. They are therefore, among other things, responsible for placing the orders, following up and controlling the deliveries, payments, the application of measures of authority, changes to the initial contract and additional services. AZ Sint-Maria Halle has no further tasks or responsibilities after the award of the contract and cannot be held liable or responsible for any consequences that may arise from the performance of the contract, whether it be late payments of an order placed by a contracting authority or any other contractual shortcoming committed by one of the contracting authorities, even if these are related to the technical specifications and/or performance conditions of the tender.
