Description

The subject of the contract is implemented as part of the project entitled “Construction of the Care and Treatment Facility in SPWZOZ in Stargard to improve access to long-term care in the Stargard County area” (project no. KPOD.07.08-IP.10-0180/24) co-financed from the resources of the National Reconstruction and Resilience Plan as part of the investment D4.1.1. Development of long-term care through the modernisation of the infrastructure of healthcare entities at the county level. The subject of the contract will be implemented in accordance with the requirements specified in the Annexes to the SWZ. A detailed description of the subject of the contract and the manner of its implementation is Annex No. 1.1 to the SWZ - Detailed Price Offer with a division into 10 packages and Annexes No. 7, 7.1 and 7.2 to the SWZ. Detailed provisions regarding the performance of obligations relating to this contract are contained in the draft contracts – Annexes No. 7, 7.1 and 7.2 to the SWZ. 1. The Contractor, in order to confirm compliance with the conditions of participation in the procedure and to demonstrate the absence of grounds for exclusion under Article 125 of the PZP Act, is obliged to submit with the offer a declaration of non-exclusion and compliance with the conditions of participation in the procedure, in the scope indicated by the Contracting Authority: 1) The declaration of non-exclusion and compliance with the conditions of participation in the procedure is submitted on the Form of the Single European Standardised Procurement Document, in short “SESPD”, drawn up in accordance with the standard form specified in the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form of the Single European Standardised Procurement Document (OJ L 3, 06.01.2016) in accordance with the form constituting Annex No. 2 to the SWZ. 2) In order to confirm compliance with the condition of technical or professional capacity, the Contractor is obliged to declare that it has properly completed in the last three years before the expiry of the offer submission deadline, and if the period of business activity is shorter – in this period – a minimum of two deliveries (each delivery understood as one contract) corresponding in type and scope to the subject of the contract – Annex No. 8 to the SWZ. The minimum gross values of each of the deliveries required by the Contracting Authority have been specified in the SWZ. 3) In the case of joint tendering for the contract by Contractors, each Contractor submits the SESPD. 4) In the case of reliance on the capacities or situation of entities providing resources, the Contractor also submits the SESPD of the entity providing the resources together with the commitment of the entity providing the resources to make the necessary resources available to the Contractor for the implementation of the contract or another documentary evidence confirming that the Contractor, when implementing the contract, will have the necessary resources of these entities. 5) In the scope of Part IV of the SESPD, the Contractor may limit itself to completing section α and does not have to complete any of the other sections in Part IV. 2. Before selecting the most advantageous offer, the Contracting Authority will call upon the Contractor whose offer has been most highly evaluated to submit, within a specified period, not shorter than 10 days, documentary evidence current as of the date of submission: 1) In order to confirm that the Contractor meets the conditions of participation in the procedure regarding the required authorisations to carry out a specified economic or professional activity, the Contractor, if required by the nature of the contract, will submit a document confirming the possession of the qualifications or authorisations to carry out a specified professional activity (in accordance with § 7(1) of the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on documentary evidence and other documents or declarations which the Contracting Authority may require from the Contractor) - current permit, licence, concession or entry in the register of regulated activity. 2) Information from the National Criminal Register drawn up no earlier than 6 months before its submission, in the scope of: a) in accordance with Article 108(1)(1) and (2) of the PZP Act, concerning a final conviction for certain offences and b) in accordance with Article 108(1)(4) of the PZP Act, concerning a court order banning participation in public procurement as a criminal penalty, 3) The Contractor’s declaration, in the scope of Article 108(1)(5) of the Act - the form of the declaration is Annex No. 3 to the SWZ, 4) a copy or information from the National Court Register or from the Central Information and Information System on Economic Activity, in the scope of Article 109(1)(4) of the Act, drawn up no earlier than 3 months before its submission, if separate provisions require entry in the register or record. 5) the Contractor’s declaration of the currency of the information contained in the SESPD, in the scope of the grounds for exclusion from the procedure indicated by the Contracting Authority - the form of the declaration is Annex No. 4 to the SWZ. As documentary evidence, the Contractor is obliged to submit with the offer for each product offered (if a given product requires it): catalogues with a detailed description of the product, certificates or declarations of conformity, instructions (if a given product has such an instruction), technical descriptions and warranty cards; which documents will be in the Polish language, to confirm the conformity of the offered product with the description of the subject of the contract and the compliance with the standards and requirements provided for by the law for the individual assortment specified in Annex No. 1.1 to the SWZ – Detailed Price Offer by individual packages. The Contracting Authority envisages the supplementation of documentary evidence in accordance with Article 107(2) of the PZP.
