Bulgaria – Construction supervision services – СКЛЮЧВАНЕ НА РАМКОВО СПОРАЗУМЕНИЕ ЗА УПРАЖНЯВАНЕ НА СТРОИТЕЛЕН НАДЗОР ЗА ИЗГРАЖДАНЕ НА ЕЛЕМЕНТИ ОТ ТЕХНИЧЕСКАТА ИНФРАСТРУКТУРА В ОБЩИНА „МАРИЦА”, ОБЛАСТ ПЛОВДИВ“

With the conduct of the current procedure, the Contracting Authority aims to conclude a framework agreement with up to three contractors for a period of up to 4 years for the exercise of construction supervision for the construction of elements of the technical infrastructure in the Municipality of "Maritsa", Plovdiv Region. The services, which are the subject of the framework agreement, include: Exercise of construction supervision in accordance with Article 168 of the Spatial Planning Act for the construction of elements of the technical infrastructure in the Municipality of "Maritsa", Plovdiv Region. For the activities, which are the subject of the contract, the contractor must comply with the requirements of Article 168 and subsequent articles of the Spatial Planning Act: 1. Exercise of construction supervision during the construction until the acceptance and commissioning of the respective construction in the mandatory scope, regulated in the Spatial Planning Act and the subordinate legal acts for its application; 2. Participation in the preparation of all the required acts and protocols during the construction; 3. Provision of technically competent individuals from their team, determined for the supervision of the construction for the respective design parts, for the preparation of the acts and protocols, regulated with Ordinance No. 3 of 2003 for the preparation of acts and protocols during the construction; 4. Carrying out control regarding the completeness and correct preparation of the acts and protocols during the construction; 5. Opening of the construction site and determination of the construction line and level for the construction; 6. Preparation, completion, threading and numbering of the pages of the Construction Order Book; 7. Exercise of control with regard to the lawful commencement of the construction. Stopping the construction, when it is carried out under the conditions of Article 224, paragraph 1 and Article 225, paragraph 2 of the Spatial Planning Act and in violation of the requirements of Article 169, paragraph 1 and 3 of the Spatial Planning Act; 8. Carrying out control regarding the observance of the requirements for health and safe working conditions in construction; 9. Exercise of control with regard to the prevention of damage to third parties and properties as a result of the construction; 10. Notifying the Regional Directorate for National Construction Control in case of a violation of the technical rules and standards, within 3 days from the establishment of the violation; 11. Carrying out a check and control of the delivered and incorporated in the construction building products, with which the main requirements for the constructions, determined in Annex I of Regulation (EU) No 305/2011 of 9 March 2011 on the laying down of harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (OJ, L 88/5 of 4 April 2011), are ensured, as follows: - mechanical resistance and stability of the construction/building structures and of the ground base under loads during construction and under operational and seismic loads; - safety in case of fire; - hygiene, health and environment; - accessibility and safety in operation; - protection against noise; - energy saving and heat retention - energy efficiency; - sustainable use of natural resources. 12. Issuance of instructions and orders regarding the construction, recording of the same in the Construction Order Book and exercise of subsequent control over their implementation; 13. Control over the implementation of orders and instructions, recorded in the Construction Order Book by other competent bodies and persons; 14. Performance of the obligations arising for the person exercising construction supervision, from the provisions of Ordinance No. 1 of 16 April 2007 on the examination of accidents in construction; 15. Certification of the executive documentation, when the same meets the requirements of the Spatial Planning Act and the completed construction and assembly works; 16. Organisation of the conduct of 72-hour tests under operating conditions as part of the process of preparation for commissioning if such are necessary, incl. formation of a commission, preparation of an order of the Contracting Authority and signing of Protocols for conducted 72-hour tests under operating conditions (Annex No. 17 to Ordinance No. 3 of 2003 for the preparation of acts and protocols during the construction) /if applicable/; 17. Provision of the services of specialists among the individuals, indicated in the certified list of the team of the competent individuals, through whom the activity is exercised – an integral part of the issued to the Contractor certificate for the exercise of the activities under Article 166, paragraph 1, item 1 in accordance with Article 166 paragraph 2 of the Spatial Planning Act, and if necessary – and the services of other specialists; 18. Control over the geodetic survey of the object by the Contractor under the Construction Contract (design, construction and exercise of author's supervision), preparation of documentation for the issuance of the Certificate under Article 54a of the Cadastral and Property Registers Act and Article 175 of the Spatial Planning Act: 19. Exercise of control of the Contractor under the Construction Contract for the preservation of the geodetic marks /axis stones, reference points, Working Geodetic Base /WGB/, and others/. If it is inevitable to remove a geodetic mark, it must carry out a precise re-marking. Before the removal of the mark, the Contractor must notify the Contracting Authority and restore the destroyed points from the WGB. 20. Preparation of the necessary documentation for the issuance of a Certificate from the service for geodesy, cartography and cadastre, that the obligation under Article 54a, paragraph 2 of the Cadastral and Property Registers Act for the object has been fulfilled, in accordance with the provisions of Ordinance No. RD-02-20-5 of 15 December 2016 on the content, creation and maintenance of the cadastral map and cadastral registers 21. Preparation of a Final Report for the construction, in accordance with Article 168, paragraph 6 of the Spatial Planning Act 22. Preparation of a Report on the implementation of the Plan for the management of construction waste in accordance with Annex No. 6 of the Ordinance of 05.12.2017 on the management of construction waste and the use of recycled construction materials. 23. Performance of the functions of the Safety and Health Coordinator.
