France – Construction work for school buildings – Marché global de performance pour l'opération de réhabilitation, extension et construction neuve du groupe scolaire et de la crèche CADENAT - PHASE CANDIDATURES

Given the performance objectives of the contracting authority for this operation, the Company has opted to award a performance-based contract in accordance with the provisions of Article L. 2173-3 of the Public Procurement Code. The choice of such a procurement method leads to the non-allotment of the contract and, consequently, to the use of a single contract. The present public performance contract includes the following services: - Design and Construction of rehabilitation, extension, construction, and exterior improvement works. - Operation and maintenance of the equipment, including those that enable monitoring and compliance with performance standards. It concerns the rehabilitation and extension of the Cadenat school group (3 place Cadenat and rue Jobin) and the construction of the CADENAT nursery, rue Jobin - 13003 Marseille. The present project is described in the programmatic note and the "site dossier" attached to the Consultation Regulations. The estimated contract value is: 13,000,000 euros excl. VAT. This amount includes: Design; Works; Operation - maintenance. The contracting authority reserves the right, during the competitive dialogue, to optimize, specify, or modify the description of the needs. The present contract is divided into several phases/technical parts as follows: - Phase 1: Design studies; - Phase 2: Construction works; - Phase 3: Operation - maintenance 60 months. Any optional sections will be defined in the initial tender dossier. The contracting authority reserves the right, during the consultation, to create, modify, or delete one or more optional sections, provided that these changes do not constitute a substantial modification of the consultation conditions or the contract object. The present performance contract is awarded through a competitive dialogue procedure in accordance with Article L. 2124-4, R.2161-24 to R.2161-31, L.2171-3, R.2171-2, R.2171-3 of the Public Procurement Code. This procedure is justified by the specific and complex nature of the need, which requires a dialogue with candidates to define or develop one or more solutions capable of meeting the contracting authority's requirements. The procedure is described in the Consultation Regulations. The modalities of the dialogue phase are described in the Consultation Regulations. The contract may, in principle, be concluded with a single contractor or a consortium of companies. In the event of a joint venture, the lead contractor will be jointly and severally liable for the other members of the consortium. In the event of a joint venture, if it does not take this form at the time of submission of its tender or offer, the contracting authority reserves the right to require the winning consortium to take the form of a joint venture with a jointly and severally liable lead contractor. In accordance with the provisions of Article R. 2142-26 of the Public Procurement Code, the composition of the tendering consortium may not, in principle, be modified between the deadline for receipt of tenders and the signature of the contract resulting from the present competitive dialogue procedure. Any request for modification of the composition of the consortium may only be considered in the strictly limited cases provided for in Article R. 2142-26 of the Public Procurement Code. In accordance with Article R. 2142-21 of the Public Procurement Code, a candidate may apply both as an individual candidate and as a member of one or more consortia, or as a member of several consortia BUT WITHIN THE FOLLOWING LIMITS: The general contractor (works competence) and the architect (architecture competence) may only tender as part of a single team. For other services/competences, the possibility of submitting a tender as a member of several consortia applies. The notification date given in this notice is purely indicative.
