Poland – Supervision of building work – Pełnienie funkcji inspektora nadzoru dla zadania: Rozbudowa drogi wojewódzkiej nr 559 w km 45+060 do km ok. 46+730 w m. Maszewo Duże, gm. Stara Biała – nr postępowania 174/26

1. Performing the function of an inspection supervisor for the task: Expansion of the provincial road no. 559 from km 45+060 to approx. km 46+730 in Maszewo Duże, gm. Stara Biała – procedure no. 174/26

2. A detailed description of the subject of the Contract is in Section IV SWZ – General Contract Conditions.

3. In case the description of the subject of the contract indicates trademarks, patents, or origin, source, or a special process that characterizes the product or services provided by a specific contractor, the Purchaser allows equivalent solutions.

4. In case the description of the subject of the contract refers to standards, European technical approvals, certifications, technical specifications, and technical reference systems, the Purchaser allows equivalent solutions described.

5. The subject of the contract has not been divided into parts. The Purchaser does not allow partial offers to be submitted.

6. The Purchaser plans to award contracts, as referred to in Article 214(1)(7) of the Pzp Act, with a net value of 627,306.36 PLN. In the scope of similar services, the Purchaser plans to provide supervision over the execution of the following works:

- preparatory works

- landscaping works

- demolition works

- earthworks

- substructure

- installation of safety devices

- kerbs, edgings, curbs and pavement

- strengthening the soil subgrade

- road safety devices

- works in the scope of traffic organization and BRD

- finishing works

- works in the scope of stormwater and sanitary sewerage

- works in the scope of water supply and pipelines

- works in the telecommunications sector

- works in the power sector

- construction of road lighting

The aforementioned supervision service concerns the section on which the construction works will be carried out and/or adjacent sections.

7. The Contractor is obliged to have current civil liability insurance (OC) for damages caused during the execution of the contract and to third parties for the entire period of the contract and for an amount not lower than 500,000.00 PLN. The Contractor is obliged to submit a copy of the aforementioned policy within 7 days from the date of signing the contract. Provided that the insurance is continuous, the Purchaser allows the possibility of presenting several policies during the contract period confirming the possession of OC insurance. The Contractor is obliged to submit a copy of the next policy to the Purchaser within 7 days from the expiry date of the previous policy. If the Contractor fails to comply with the above, the Purchaser will charge the Contractor with contractual penalties in the amount specified in the contract. In the event of failure to submit the policy within 30 days from the date of signing the contract, the Purchaser will have the right to withdraw from the contract.

8. The Purchaser requires that the investor supervision service be carried out from the date of signing the contract until the completion and settlement of the contract, which is the subject of the supervision, i.e. within 81 months from the date of signing the contract, including:

- Stage I: up to 18 months from the date of signing the contract – period of supervision over construction works,

- up to 21 months from the date of signing the contract – supervision during the period in which the Contractor is obliged to obtain a permit for the use of the facility.

The contract implementation period may change proportionally to the implementation period of the construction works and obtaining a decision on the permit for the use of the facility.

- Stage II: up to 60 months from the date of signing the acceptance protocol of the contract subject for construction works – period of supervision after the completion of construction works.

9. The Contractor, whose offer was selected as the most advantageous, will provide a guarantee of proper contract performance in the amount of 5% of the value of Stage I of the contract gross. The requirements regarding the guarantee of proper contract performance are described in Section XX of Part I SWZ.

10. The Purchaser plans to apply the so-called reverse procedure, as referred to in Article 139(1) of the PZP Act, i.e. the Purchaser will first carry out an examination and evaluation of the offers, and then carry out a subjective qualification of the Contractor, whose offer was highest rated, in terms of the lack of exclusion bases and meeting the conditions of participation in the procedure.

11. In accordance with Article 257 of the PZP Act, the Purchaser plans the possibility of invalidating the subject of the procedure if the public funds that the Purchaser intended to allocate for the financing of the whole or part of the contract have not been granted to it.
