Description
The procurement is conducted as a negotiated procedure in accordance with the Public Procurement Act, Sections 61-66, with a prior pre-qualification. The contracting authority reserves the right not to conduct a negotiation and thus to award the contract based on the initial tender. The award criterion is "The best price-quality ratio" in accordance with the Public Procurement Act, Section 162, No. 3. Among the applicants for pre-qualification, four teams are selected, which are invited to submit tenders. The tender phase begins with a joint inspection of the existing school and outdoor areas. After the inspection, tenderers are invited to a voluntary dialogue meeting with the contracting authority with a view to discussing the intended architectural main features of the tender. The purpose of the meeting is to give the bidders the opportunity to clarify any questions and gain an updated understanding of the architectural framework and intentions. The contracting authority will not evaluate the qualitative sub-criteria before, during or after the meeting. The dialogue meeting is solely for the purpose of giving the contracting authority the opportunity to point out and draw attention to the tenderer's response to qualitative sub-criteria. After the dialogue meetings, the tenders are finalised and submitted via the project web. The tenders are then evaluated by an evaluation committee consisting of representatives from the contracting authority's organisation, construction client advisors and external experts. Based on the evaluation, the contracting authority decides whether to conduct a negotiation round, or whether the task is awarded directly based on the initial tenders, which in that case become the tenderers' final tenders. If the contracting authority chooses to conduct a negotiation round, selected tenderers are invited, which takes place in individual negotiation meetings. The contracting authority conducts the procurement as a negotiated procedure in several phases with a view to limiting the number of tenders to be negotiated, cf. the Public Procurement Act, Section 62, paragraph 2, No. 2. The contracting authority expects to invite 4 companies to submit initial tenders. After a preliminary evaluation of the initial tenders according to the award criterion 'best price-quality ratio' (with associated sub-criteria and weighting), the contracting authority reduces the number of tenderers to the 2 tenderers who are collectively assessed as having submitted the best tenders. These are invited to negotiation. Should the tenders assessed as No. 2 and No. 3 in the initial evaluation differ by less than 2.00 points (1.99 points or less) in total according to the award criterion 'best price-quality ratio', the contracting authority will increase the above number so that 3 tenderers in total are invited to negotiation. The reduction is made on the basis of the award criterion in accordance with the Public Procurement Act, Section 66, paragraph 3, and Section 146, paragraph 1. Tenderers who are not invited to the next phase are notified with a reason based on the award criterion. Unless the contracting authority chooses to award the contract based on the initial tender, one or more negotiation processes are conducted, as described below: The tenderers will therefore be invited to individual negotiation meetings, which are held in parallel. Based on the negotiations, the contracting authority draws up a joint report (correction sheet) and individual reports. The joint report concerns the tender material/tender process and is made available to all tenderers. The individual reports concern each of the tenderers' tenders and are sent only to the individual tenderer. If a question or reservation from a tenderer gives the contracting authority reason to consider a change in the tender material, the contracting authority reserves the right to present the relevant change proposal to the remaining tenderers. Any amended tender material will be made available on the digital tender portal cf. the tender conditions, point 3.2. The contracting authority reserves the right to extend the number of negotiation rounds. In that case, the above applies to all negotiation meetings. After the negotiation round, the tenderers revise their final tenders on the basis of individual and joint feedback from the contracting authority. The revised tenders are then evaluated by the evaluation committee. The tender phase concludes with the issuance of the evaluation and designation of a winner. After the standstill period has expired, Fredericia Municipality intends to enter into a design and build contract with the winning tenderer. An economic operator is excluded from participation if the economic operator is covered by one of the mandatory exclusion grounds in the Public Procurement Act, Section 135, paragraph 13 and Section 136, paragraph 1, No. 1.3. Furthermore, an economic operator is excluded from participation if the economic operator is covered by the voluntary exclusion grounds in the Public Procurement Act, Section 137, paragraph 1, No. 1) and 2). An economic operator cannot be excluded from participation if the economic operator submits sufficient documentation that the economic operator is reliable, even if the economic operator is covered by one or more of the exclusion grounds in the Public Procurement Act, Sections 135-137, cf. the Public Procurement Act, Section 138, paragraph 1. Council Regulation (EU) 2022/576. Contracts cannot be awarded to the following companies, cf. Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine: A. Russian nationals or natural or legal persons, entities or bodies established in Russia B. legal persons, entities or bodies, of which an entity as referred to in the present paragraph, litra a) directly or indirectly owns more than 50 %, or C. natural or legal persons, entities or bodies, acting on behalf of or upon the instructions of an entity as referred to in the present paragraph, litra a) or b). Likewise, subcontractors or supporting units covered by the above may not be used if this actor's contribution amounts to more than 10 % of the contract value.
