Description

The subject of the contract is specifically: a) providing technical support and maintenance services for the ZSZO System for the duration of the contract, as part of the base contract; b) providing development services for a maximum of 1 200 man-hours, for the duration of the contract, as part of the option right. The detailed description of the subject of the contract contains the contract template with annexes, which is Annex No. 11 to SWZ. 2. The contracting authority in this procedure does not divide the contract into parts or allow partial offers to be submitted: The subject of the contract, namely the provision of Technical Support and Maintenance Services for the ZSZO System and development services, cannot be divided into parts for technical, purposeful and economic reasons, as it constitutes a coherent whole. Dividing the contract into parts could lead to coordination difficulties, increased risk of improper service provision and threat to the continuity of the system's operation. The integrated nature of the system means that support services should be provided by one entity responsible for the overall functioning of the system. The lack of division into parts in no way limits access to the contract for small and medium-sized enterprises, and Contractors operating in the industry covered by the subject of the contract can provide all its elements. 3. The contracting authority does not require the contract to be executed by sheltered workshops, social cooperatives, or other contractors covered by the provisions of Article 94(1) of the Act of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2026, item 793 as amended), hereinafter referred to as the "Act". 4. The contracting authority, pursuant to Article 95(1) of the Act, requires the Contractor (or subcontractor) to employ persons performing remote assistance services of the CALL CENTER type, as mentioned in point 5 of the Annex to the Contract. Performing these tasks involves working in the manner specified in Article 22(1) of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2025, item 277 as amended). (This requirement does not apply to natural persons conducting business activity and partners of civil law partnerships who undertake to provide these services personally for the partnership.) 5. The contracting authority does not envisage the possibility of granting contracts, as mentioned in Article 214(1)(7) of the Act. 6. The contracting authority does not allow the submission of alternative offers. 7. The contracting authority does not envisage conducting an electronic auction. 8. The contracting authority did not conduct preliminary market consultations before initiating the procedure. 9. The contracting authority does not require Contractors to submit substantive evidence in this procedure. 10. The contracting authority, within the limits set out in Article 462 and subsequent articles of the Act, allows the possibility of the Contractor executing the subject of the contract using subcontractors. A Contractor who intends to entrust the execution of part of the contract to subcontractors indicates in the offer the parts of the contract which they intend to entrust to subcontractors, and provides the names of any potential subcontractors, if known. 11. Justification for the application of the price criterion 80% - The contracting authority has described the quality requirements, as mentioned in Article 246(2) of the Act, in detail in the contract template with annexes.
