The contractor (Contractor) commits to providing the managed operation of the canteen in the Henning-von-Tresckow Barracks (Property), as detailed in the service description in Appendix 1 to the Service Contract, and to ensure this through independent operational planning including independent use of goods and personnel. For the provision of the required service, the Contractor receives a monthly remuneration, the amount and calculation of which must be specified by the Contractor in their tender. The revenue generated by the Contractor within the framework of the canteen operation also remains with them; only when the turnover achieved by the Contractor within a calendar year plus the remuneration paid by the contracting authority (Contracting Authority) exceeds the costs incurred for the canteen operation, the remuneration by the Contracting Authority is reduced by part of the amount exceeding the costs. The contract term is five years (with two possible extensions of one year each). The current planned start of service is 3 December 2026; this date is explicitly not guaranteed and may change during the course of the tender procedure. The subject of the service is the provision of an attractive gastronomic offer by the Contractor, which, in addition to meals oriented towards the troops, creates an atmosphere that invites people to linger and enables a convivial togetherness. For the operation of the canteen, the Contracting Authority provides the Contractor with premises (including terrace) and property materials located therein. The transfer is free of charge, i.e. no rent is charged. The Contracting Authority also bears the costs for the property operating services provided by it (Facility Management such as media supply (water, electricity, heat), waste water disposal and waste disposal). Details are regulated in the regulations for the transfer of Bundeswehr properties to third parties as contractors [RÜL] (Appendix 3 to the Service Contract). The Contractor equips the dining rooms of the canteen at their own expense. The Contracting Authority furnishes the terrace. The Contractor is also responsible for the procurement of glasses, crockery and cutlery as well as the cash register system. The Contractor must offer certain dishes and beverages at contractually fixed prices (see Appendix 9 to the Service Contract, basic range). The prices are adjusted to the price development annually in February. The availability of the basic range must be ensured. For all dishes beyond the dishes of the basic range, the Contractor is free to set the price.
