Description

Procurement contracts framework for the supply of ferric chloride solution, required for the removal of phosphorus and hydrogen sulfide in wastewater treatment, and for arsenic removal in drinking water treatment, as well as a chemical for preventing silting and removing phosphate, for Debreceni Vízmű Zrt. 1) The present procedure aims to establish the DBR. Given the estimated value of the procedure, the Second Part of the Kbt. is applied according to Kbt. Sections 106-107, i.e., the rules of the procurement procedure for setting up (so-called first, participation phase) and implementing (so-called second, tender phase) a dynamic procurement system (hereinafter DBR). The Inviting Entity applies the rules of the participation phase of the invitation procedure for inclusion in the DBR and the rules of the tender phase of the invitation procedure for procurements within the DBR, with deviations applicable to the DBR. [Kbt. Section 107. (1)-(2)]. We draw the attention of the Participants to the fact that in the present first, participation phase of the DBR, the Participant may not submit a tender! 2) The Inviting Entity defines 2 categories (parts) in the present, participation phase of the DBR. 1. Category (part): Procurement of ferric chloride solution. 2. Category (part): Procurement of anti-silting chemical. 2) The duration of the DBR: 36 months from the establishment of the DBR. Rules for participation registration 3) During the validity period of the DBR, any economic operator (participant) who - is not subject to exclusion grounds - meets the suitability requirements and - submits a participation registration compliant with the procurement documents, may request inclusion in the system at any time. The condition for inclusion in the DBR is the submission of the participation registration defined in the procurement documents, the prior proof of compliance with the suitability requirements, and the non-existence of the prescribed exclusion grounds. 4) The possibility to join the DBR - by submitting a participation registration compliant with the procurement documents - is continuous, and in the second, tender phase, all participants included in the DBR at the time of the given procurement may submit a tender. A) In the first, participation phase of the DBR, there is an opportunity to submit participation registrations until the participation deadline. B) After the expiry of the participation deadline prescribed in the first, participation phase of the DBR, there is an opportunity to join (submit a participation registration) the already established DBR at any time during its full validity period. 5) Therefore, those economic operators who did not submit their participation registration for inclusion in the DBR by the expiry of the participation deadline in the first, participation phase, may do so at any time during the full validity period of the DBR, after the dispatch of the summary of the first, participation phase. In the case of a participation registration following the dispatch of the summary of the first, participation phase, it is also necessary to submit in the participation registration all those documents whose submission is mandatorily prescribed by the participation invitation and the participation documentation. After submitting a valid participation registration, the late registrants are included in the DBR and are only entitled to participate in the second, tender phase after inclusion. 6) We draw the attention of the registrants to the fact that if they submit their participation registration after the expiry of the participation deadline for the establishment of the DBR but before the dispatch of the summary, their participation registration is classified as late in this evaluation phase. In this case, the provisions of point 5) above apply. The Inviting Entity sends the tender invitation to those economic operators who have been included in the DBR for the implementation of the specific procurement needs. If the participant submits their participation registration after the establishment of the DBR and the Inviting Entity has not yet evaluated the registration before sending the given tender invitation, the Inviting Entity does not send the given tender invitation to this participant. 7) In the first, participation phase of the DBR aimed at the establishment of the DBR, the participants must pre-declare their compliance with the minimum suitability requirement(s) in the participation registration by completing the "alpha" point of Chapter IV of the EEKD. The proofs prescribed within the minimum suitability requirement(s) do not need to be attached to the participation registration, they must be submitted as required in the second, tender phase, based on the Inviting Entity's call pursuant to Kbt. Section 69. (4). 8) We draw the attention of the participants to the fact that in the present first, participation phase of the DBR, the participant may not submit a tender! 9) In the second, tender phase of the DBR, the Inviting Entity evaluates the tenders based on the lowest price selection criterion according to Kbt. Section 76. (2) a), taking into account that the expected quality and technical requirements are concretely defined in the procurement documents and technical descriptions of the second, tender phase, as well as in the draft contracts, and in the event of compliance with the conditions defined in the draft contract sent simultaneously with the tender invitation, the goods meet the requirements of the Inviting Entity, and further quality and technical characteristics do not influence the selection of the economically most advantageous tender. The Inviting Entity defines other requirements related to the tender price in the tender phase. 10) In the present procedure, the Inviting Entity does not define a framework amount.
