The subject of the contract is: the management of waste with code 19 12 10 – combustible waste (alternative fuel) and the management of waste with code 19 12 12 (over 80 mm) – Other waste (including mixed substances and items from mechanical processing of waste other than those mentioned in 19 12 11) from the Waste Management Plant (ZZO) in Nowy Sącz at ul. Tarnowskiej 120. The estimated quantity of waste to be managed is 24,000 [Mg] in total, including: 19 12 10 – 20,000 [Mg] and 19 12 12 – 4,000 [Mg]. The Contracting Authority reserves the right that the specified quantity of waste is an indicative quantity and the management of waste in a quantity less than 24,000 [Mg] does not give rise to any liability on the part of the Contracting Authority, with the reservation that the Contracting Authority is obliged to transfer to the Contractor for the purpose of management at least 4,000 [Mg] of waste, and for the failure to transfer this minimum quantity the Contracting Authority shall bear liability for compensation on the general principles provided for by generally applicable law. The minimum threshold of waste that the Contracting Authority will transfer to the Contractor for the purpose of management is 4,000 Mg. However, the Contracting Authority reserves the right to transfer for management throughout the service implementation period, in the total tonnage of waste covered by the contract, a larger or smaller quantity of waste of each of the codes 19 12 10 and/or 19 12 12 depending on its current needs (for example 21,000 Mg of waste 19 12 10 and only 3,000 Mg of waste with code 19 12 12 etc.), the Contractor will not raise any objections to the alternative possibility of transferring waste by the Contracting Authority, ensuring the possibility of implementing the service with the consideration of at least 4,000 Mg of each of the above fractions in total, i.e. 19 12 10 or 19 12 12. The delivery of waste to the Contractor will take place on weekdays from Monday to Friday from 7:00 to 21:00, excluding statutory holidays. After weighing on the Contracting Authority's weighbridge, the Contracting Authority will hand over the weighing ticket to the driver and issue a waste transfer card in the Database of Products and Packaging and Waste Management (BDO). Waste with code 19 12 10 and 19 12 12 is regularly produced sorted material as so-called oversize fraction > 80mm in the form of a calorific fraction with a calorific value greater than 6 MJ/kg of dry matter coming from: a) the mechanical processing process of mixed municipal waste with code 20 03 01, which before the start of the processing process are stored on the site, then directed to the shredder, then by means of conveyors directed to the 0-80 mm sieve, then to the sorting cabin, further by conveyor with a magnetic separator and then to storage sites as waste with code 19 12 10 and 19 12 12; b) from selectively collected waste with codes 15 01 01, 15 01 02, 15 01 05, 15 01 06 and 20 01 01, 20 01 39 (waste before being subjected to the processing process are stored on the site, then directed to the tearing device, then by means of conveyors directed to the sorting cabin, further by conveyor with a magnetic separator and then to storage sites as waste with code 19 12 10 and 19 12 12); c) from the processing of bulky waste with code 20 03 07 on a shredder equipped with a magnetic separator (it is noted that bulky waste before being subjected to the processing process are manually cleaned). The waste produced after the processing process with code 19 12 10 and 19 12 12 are stored loosely on a hardened covered site. The weighing of waste with code 19 12 10 and 19 12 12 will take place at the Contracting Authority in the Waste Management Plant (ZZO) in Nowy Sącz at ul. Tarnowskiej 120 on the weighbridge with a capacity of 50 t and dimensions 18m x 3m. The transport of waste to the waste management facility for fractions 19 12 10 and 19 12 12 will be carried out by transport organised by the Contracting Authority and at its expense. The Contracting Authority specifies the maximum distance from the Waste Management Plant (ZZO) Nowy Sącz ul. Tarnowska 120 to the waste management facility (measured by public roads passable for heavy goods vehicles, not internal and field roads, etc., not measured in a straight line) up to 300 km. Additional requirements of the Contracting Authority: 1. The Contracting Authority does not envisage carrying out a local inspection of the place of implementation of the contract and does not envisage verifying the documents necessary for the implementation of the contract which are in the disposal of the Contracting Authority, and which will be made available to entities expressing a willingness to participate in the procedure. 2. The implementation of the subject of the contract should be carried out in accordance with the provisions applicable in this respect, and in particular with: a) the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2023 item 1587, 1597, 1688, 1852, 2029, of 2024 item 1834, 1911, 1914, of 2025 item 1812, of 2026 item 174, 815, 875), b) the Act of 27 April 2001 on Environmental Protection Law (i.e. Journal of Laws of 2025 item 647, 1080, 1812, 1863, of 2026 item 176, 426, 605, 607, 635, 912, 982, 1157), c) the Act of
