Poland – Special-purpose road passenger-transport services – Usługa przewozu osób z niepełnosprawnościami na terenie Gminy Miejskiej Kraków

1. Contract Title: „Transport Service for Persons with Disabilities within the Municipal Area of Kraków”. 2. The subject of the contract is the transport of persons with disabilities residing within the Municipal Area of Kraków in accordance with the terms specified in the model contract and its annexes (in particular Annex No. 2 to the model contract, i.e. the Regulation on the Transport of Persons with Disabilities). The transport is carried out exclusively within the Municipal Area of Kraków. The expected scope of transport is defined by the number of approximately 816 000 kilometres of transport, including: - 2026 – 34 000 kilometres of transport, - 2027 – 408 000 kilometres of transport, - 2028 – 374 000 kilometres of transport. By transport is meant a journey with at least one eligible person with a disability. 3. The Contractor is obliged to have and maintain throughout the period of performance of the subject of the contract an appropriate civil liability insurance policy for the activity related to the subject of the contract, in the amount of insurance of at least 600 000,00 PLN, which will be presented upon the conclusion of the contract. 4. The detailed description of the subject of the contract contains the model contract together with the annexes, which is Annex No. 12 to the SWZ. The Contracting Authority does not allow the submission of partial offers, the reason for not dividing the contract into parts has been indicated in point 3.6 of the SWZ. 5. The Contracting Authority does not require the implementation of the contract by sheltered workshops, social cooperatives, or other contractors covered by the provisions of Article 94(1) of the Act of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2026, item 793, as amended), hereinafter referred to as the „Act”. 6. The Contracting Authority, pursuant to Article 95(1) of the Act, requires the employment, throughout the period of performance of the subject of the contract, on the basis of an employment contract, by the Contractor (or subcontractor) of at least two persons in dispatcher-coordinator positions. The performance of these tasks involves working in the manner specified in Article 22(1) of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2026, item 1245). Persons employed in dispatcher-coordinator positions must use the Polish language at a level of at least communicative. Note! The above requirement does not apply to: natural persons conducting business activity, who will undertake to provide the services specified above personally, and partners of partnerships, who will undertake to provide these services personally for the partnership. 7. The Contracting Authority envisages the possibility of awarding contracts, as referred to in Article 214(1)(7) of the Act, in an amount not exceeding 120% of the value of the basic contract. These contracts will involve the repetition of similar services in relation to those described in this procedure in the model contract and its annexes. The conditions under which the above contracts will be awarded will correspond to the conditions specified in this procedure in the model contract and its annexes, however, the conditions of participation in the procedure will be limited relevantly to the repeated scope of the contract. In this connection, the Contracting Authority, when determining the value of this contract, took into account the value of the contracts, as referred to in Article 214(1)(7) of the Act, in the amount of: 9 204 480,00 PLN net. Note! The estimated value of the contract indicated in point 2.1.3. of the notice includes the value of the envisaged contracts, as referred to in Article 214(1)(7) of the Act, in the amount of 9 204 480,00 PLN net. 8. The Contracting Authority does not require Contractors to submit tangible evidence in this procedure. 9. The Contracting Authority does not envisage the conduct of an electronic auction. 10. The Contracting Authority conducted preliminary market consultations before initiating the procedure. 11. The Contracting Authority, within the limits specified in Article 462 and subsequent provisions of the Act, allows the possibility of implementing the subject of the contract by the Contractor using subcontractors. A Contractor who intends to entrust the performance of part of the contract to subcontractors indicates in the offer the parts of the contract, the performance of which he intends to entrust to subcontractors, and provides the names of potential subcontractors, if they are already known. 12. The Contracting Authority does not require the submission of an electronic catalogue in this contract, in the meaning of Article 93 of the Act. 13. The justification for the application of the 100% price criterion has been indicated in point 3.16 of the SWZ. 14. Note! The correct description of the item entitled "electronic catalogue" in point 5.1.12. of the notice is: The Contracting Authority does not require the submission of an electronic catalogue in this contract, in the meaning of Article 93 of the Act. 15. The Contracting Authority indicated the correct deadline for the submission and opening of tenders in point 5.1.12. of the notice, without the "+02:00" entry imposed by the system.
