Poland – Construction work – Adaptacja budynków nr 4, 18 i 48 położonych w kompleksie przy ul. Poznańskiej na potrzeby wydziałów Komendy Wojewódzkiej Policji we Wrocławiu - w formule zaprojektuj i wybuduj

The order has been divided into two parts: Part 1: adaptation of buildings no. 4 and 48 located in the complex at ul. Poznańska for the needs of the departments of the Provincial Police Headquarters in Wrocław in the design-and-build formula; Part 2: adaptation of building no. 18 located in the complex at ul. Poznańska for the needs of the departments of the Provincial Police Headquarters in Wrocław in the design-and-build formula. The contractor may submit a bid for one or both parts of the procedure. It is required to submit a bid for the whole subject of the order in the individual parts of the procedure. 2. Within the scope of the subject of the order, which the Contractor is obliged to perform, in particular, are included: 1) development of the concept, 2) development of design and cost documentation, 3) development of technical documentation, 4) carrying out all actions to obtain the necessary permits and decisions, including, among others, surveys, expert opinions, checks, archaeological surveys, dendrological and ornithological opinions 5) performing author's supervision, 6) execution of construction works in accordance with the documentation prepared and approved by the Purchaser. 3. The Purchaser envisages the possibility of a facultative local inspection of buildings 4, 18 and 48 located in the complex at ul. Poznańska, while informing that the conduct of the local inspection is not mandatory, i.e. that the offer of the Contractor who does not attend the local inspection will not be rejected from the procedure on the basis of art. 226 par. 1 point 18 of the Pzp Act. The Purchaser sets the following dates for the inspection: - on 01.07.2026 at 11:00 - on 08.07.2026 at 11:00 The meeting of Contractors with the Purchaser's representative will take place at the main entrance gate to the complex at ul. Poznańska at the barrier, located on the other side of ul. Poznańska - opposite ZUS Branch in Wrocław. 4. The Contractor is obliged to secure his bid with a bid bond. The amount of the bid bond is: - for part 1 of the procedure: 250,000.00 PLN - for part 2 of the procedure: 470,000.00 PLN The amount of the bid bond for Contractors submitting a bid in all parts of the procedure is: 720,000.00 PLN 5. Before concluding the contract, the Contractor will be obliged to provide security for the proper performance of the contract, in accordance with the rules specified in the PZP provisions, in the amount equal to 5% of the gross offer price. 6. The Purchaser envisages the possibility of changing the concluded contract in relation to the content of the selected offer within the scope regulated in art. 454-455 of the Public Procurement Law and indicated in §6 par. 9 PPU and §25 PPU (Annex no. 2 to SWZ). 7. The Purchaser envisages the application of the procedure referred to in art. 139 par. 1 of the Pzp Act, the so-called "reverse order of bid evaluation". 8. Data protection: Chapter II SWZ. 9. The deadline for binding the bid expires on 10.11.2026. 10. In accordance with art. 257 of the Pzp Act, the Purchaser informs that it envisages the invalidation of the procedure for awarding the order, if the public funds which it intends to allocate for the financing of the whole or part of the order are not granted to it. I. 1. It is forbidden to award or further execute any public contracts or concessions covered by the scope of the directives on public procurement, as well as the scope of art. 10 par. 1, 3, par. 6 lit. A)–e), par. 8, 9 and 10, art. 11, 12, 13 and 14 of directive 2014/23/EU, art. 7 and 8, art. 10 lit. B)–f) and lit. H)–j) of directive 2014/24/EU, art. 18, art. 21 lit. B)–e) and lit. G)–i), art. 29 and 30 of directive 2014/25/EU and art. 13 lit. A)–d), lit. F)–h) and lit. J) of directive 2009/81/EC on behalf of or with the participation of: a) Russian citizens, natural persons residing in Russia or legal entities, bodies or organs with their seat in Russia; b) Legal entities, bodies or organs, to which the rights of ownership directly or indirectly belong more than 50% to a natural or legal person, body or organ, as referred to in lit. a) above; or c) Natural or legal persons, bodies or organs acting on behalf of or under the direction of a natural or legal person, body or organ, as referred to in lit. a) or b) above. including subcontractors, suppliers or entities, on whose capabilities reliance is placed in the sense of the directives on public procurement, in the event that more than 10% of the value of the order falls on them. 2. In order to meet the condition of the order, as referred to in this chapter of the SWZ, the Contractor is obliged to attach to the bid a declaration of non-inclusion in sanctions. The template for the declaration is Annex no. 3 to the SWZ. The declaration should be submitted in electronic form, in electronic form and endorsed with a qualified electronic signature. 3. The consequence of not demonstrating the fulfilment of the above condition of the order will be the rejection of the contractor's bid. II. 1. Contractors who are not excluded on the basis of art. 108 par. 1 of the Pzp Act, with the reservation of art. 110 par. 2 of the Pzp Act and art. 7 par. 1 of the Act of 15 April 2022 on special solutions in the field of counteracting the support for aggression against Ukraine and serving the protection of national security (Dz.U. of 2024, item 514 as amended) may apply for the award of the order. 2. The Purchaser does not envisage the exclusion of the Contractor within the scope of the bases specified in art. 109 of the Pzp Act.
