SUPPLY OF COILS OF STEEL IN 3 PARTS: Part 1 – JAROCIN 30 tonnes, Part 2: ŁOJEWO / INOWROCŁAW / - 30 tonnes, PART 3 - BRANIEWO - 420 tonnes; 1. The Contracting Authority envisages changes to the contract - in accordance with the provision of paragraph 13 - Annex No. 4 to SWZ. 1. According to Article 57 of the Pzp Act, Contractors may apply for the award of the contract who: 1.1. are not excluded; 1.2. meet the participation conditions: 1.2.1.ability to act in business; The Contracting Authority does not set any conditions in this respect, 1.2.2.rights to carry out a specified economic or professional activity, if this results from separate provisions; The Contracting Authority does not set any conditions in this respect, 1.2.3.economic or financial situation; The Contracting Authority does not set any conditions in this respect, 1.2.4.technical or professional capability: The Contracting Authority does not set any conditions in this respect 2. Contractors may jointly apply for the award of the contract on the basis of the content of Article 58 of the Pzp Act. 3. After evaluating the tenders, the Contracting Authority will invite the Contractor, whose tender has been assessed as the most advantageous, to submit, within a period not shorter than 10 days, current on the date of submission of declarations or documents: In the scope of confirming the absence of grounds for exclusion: -Information from the Criminal Register, drawn up no earlier than 6 months before its submission in the scope of: a) Article 108(1)(1) and (2) of the Act of 11.09.2019 PZP information about a person and b) Article 108(1)(4) of the Act of 11 September 2019 Public Procurement Law – regarding the ruling banning the application for public contracts as a criminal measure. The information from the KRK should be drawn up no earlier than 6 months before its submission and must be current on the date of submission. -copy or information from the National Court Register or from the Central Register and Information on Economic Activity, in the scope of Article 109(1)(4) of the Act, drawn up no earlier than 3 months before its submission, if separate provisions require entry in the register or record. -Contractor's declaration, in the scope of Article 108(1)(5) of the Act, on not belonging to the same capital group within the meaning of the Act of 16.02.2007 on the protection of competition and consumers (i.e. Journal of Laws 2023, item 1689 as amended), with another Contractor who submitted a separate tender, a partial tender or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the tender, partial tender independently of another -Contractor belonging to the same capital group, The template for the declaration is Annex No. 6 to SWZ -current on the date of submission of tenders declaration -Single European Procurement Document (SEPD), in electronic form, with a qualified signature 4. According to Article 257 of the PZP Act, the Contracting Authority may invalidate the public procurement procedure if the public funds which the Contracting Authority intended to allocate for the financing of the whole or part of the contract have not been granted to it. This condition has been provided for by the Contracting Authority in the content of the notice of the contract in the procedure conducted in the open procedure. 5. According to Article 139(1) of the PZP Act, the Contracting Authority informs that it will first carry out an examination and evaluation of the tenders, and then carry out the subject qualification of the Contractor, whose tender has been most highly assessed, in the scope of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. 6. The tender must include the following documents and declarations: -The completed and electronically signed tender form, drawn up on the basis of the template constituting - Annex No. 2 to SWZ; -Contractor's declaration of not being excluded from the procedure on the basis of Article 5k of Council Regulation 833/2014 as amended by Regulation 2022/576 (OJ EU No L 111 of 8.4.2022, p. 1) together with the Declaration, regarding the grounds for exclusion on the basis of Article 7(1) of the Act on special solutions in the field of counteracting the support of aggression against Ukraine. The template for the declaration is Annex No. 5 to SWZ; -Power of attorney – if applicable; -Third party commitment – if applicable; -Declaration of Contractors jointly applying for the award of the contract, from which it follows which services are provided by individual Contractors – if applicable – The template for the declaration is Annex No. 9; -Document confirming the appointment by the Contractors jointly applying for the contract of a representative to represent them in the procedure for the award of the contract – if applicable; -Information on the submission of a tender, the selection of which results in the Contracting Authority having a tax obligation under the provisions on VAT – if applicable. -Contractors' declaration on the provision of resources - if applicable – The template for the declaration is Annex No. 8 – if applicable. -The Contractor has the right to submit only one tender, containing one, unambiguously described proposal. Submission of a larger number of tenders will result in the rejection of all tenders submitted by the given Contractor. 7. The Contractor is obliged to pay a deposit before the expiry of the tender submission deadline in the amount of: Part No. 1 – 8300.00 PLN (in words: eight thousand three hundred złotys 00/100); Part No. 2 – 8300.00 PLN (in words: eight thousand three hundred złotys 00/100); Part No. 3 – 116,200.00 PLN (in words: one hundred and sixteen thousand two hundred złotys 00/100); -The deposit is paid before the expiry of the tender submission deadline and is maintained continuously until the expiry of the tender binding deadline, except in cases referred to in Article 98(1)(2) and (3) and (2). -In the event of failure to pay the deposit, or payment in an incorrect manner, failure to maintain the deposit continuously until the expiry of the tender binding deadline or submission of an application for the return of the deposit in the case
