The procedure is conducted in accordance with the provisions of the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793), hereinafter referred to as the Pzp Act. The procedure is conducted in the form of an unrestricted tender in accordance with Article 132 of the Pzp Act. The Contracting Authority awards the contract in parts, each of which is the subject of a separate procedure. The subject of the contract is the delivery of workshop tools and short-distance transport equipment, divided into 2 (two) parts of the contract. CPV Code: 44510000-8 tools, 34911100-7 trolleys. The detailed description of the subject of the contract is specified in annexes no. 1, 1.1 - 1.2. and no. 4 to the SWZ i.e.: Tender Form together with the Assortment and Price Specification and the Draft Contract Terms. The Contracting Authority allows the submission of partial offers, each of which will be evaluated by the Contracting Authority separately, according to the rules described in the SWZ. The contract has been divided into parts, in accordance with the description contained in annexes no. 1.1 - 1.2. to the SWZ. Each of the Contractors may submit an offer for any chosen part/parts. The Contracting Authority requires an offer to be submitted for all the required positions listed in annexes no. 1.1. – 1.2. to the SWZ. Whenever in this SWZ the subject of the contract is described with reference to trademarks, patents or origin, source or a particular process that characterizes the products supplied by a specific Contractor, if this could lead to the favouring or elimination of certain contractors or products, it is assumed that such indications are accompanied by the words "or equivalent". In describing the subject of the contract, on the basis of the provision expressed in Article 99(4) of the Pzp Act, the Contracting Authority has indicated a trademark or origin due to the specificity of the subject of the contract and the lack of possibility to describe it exhaustively by means of precise and understandable terms. By describing the subject of the contract using trademarks, patents or origin, source or a particular process, which characterizes the products supplied, the Contracting Authority thereby specifies the qualitative, technical and user characteristics that the subject must meet. The Contracting Authority does not reserve the possibility of applying for the award of the contract exclusively by Contractors referred to in Article 94(1) of the Pzp Act, i.e. having the status of a protected employment establishment, social cooperatives and other Contractors, the main aim or the main aim of the activity of their organizationally separate units, which will implement the contract, is the social and professional integration of socially marginalized persons.
