The subject of the contract is the collection, transport and disposal of municipal waste from inhabited and uninhabited properties located in the area of Gilowice Commune in 2027, in a manner that ensures the achievement of appropriate levels of recycling, preparation for reuse and recovery by other means, as well as the reduction of the mass of biodegradable municipal waste sent to landfills, in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in communes (i.e. Journal of Laws 2026 item 912), the provisions of the Waste Management Plan for the Silesian Voivodeship 2023 - 2028, adopted by Resolution No. VII/6/8/2024 of the Silesian Voivodeship Council of 21.10.2024 with annexes, and the provisions of the Regulation on maintaining cleanliness and order in the area of Gilowice Commune, adopted by Resolution No. XXV/166/20 of the Gilowice Commune Council of 26 November 2020 on the adoption of the Regulation on maintaining cleanliness and order in the area of Gilowice Commune and Resolution No. XXV/167/20 of the Gilowice Commune Council of 26 November 2020 on determining the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and disposing of these wastes in exchange for a paid fee, Resolution No. XXXVIII/266/21 of the Gilowice Commune Council of 27 October 2021 on amending the resolution on determining the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and disposing of these wastes in exchange for a paid fee, Resolution No. XXXVIII/264/21 of the Gilowice Commune Council of 27 October 2021 on the Regulation on maintaining cleanliness and order in the area of Gilowice Commune. The scope of the contract includes: 1) collection and disposal of municipal waste from inhabited properties, 2) collection and disposal of municipal waste from uninhabited properties, by which the Contracting Authority means a property on which holiday homes are located and properties used for recreational purposes, 3) collection and disposal of municipal waste from public places in the area of Gilowice Commune (street bins, bus stop bins) 4) equipping inhabited properties, holiday homes and recreational buildings with bio-waste collection containers – 1 container with a capacity of 120 litres per property, 5) organisation and management of the Selective Municipal Waste Collection Point (PSZOK). 2. The detailed scope of the subject of the contract is specified in Annex No. 2 to the Specification of Contract Conditions – Description of the subject of the contract, and the requirements regarding the implementation of the contract in Annex No. 5 to the Specification of Contract Conditions – Draft contract. 3. The Contracting Authority requires the Contractor or subcontractor to employ, on the basis of an employment relationship, persons performing basic technical tasks during the implementation of the contract, such as: waste removal, qualified as physical workers.
