Germany – IT services: consulting, software development, Internet and support – RV Digitalisierung (2027)

The subject of this contract is the provision of services in various areas of work in the design and implementation of the digitalisation strategies of the administrations in the Länder of Bremen, Hamburg, Saxony-Anhalt and Schleswig-Holstein, as well as at Dataport AöR itself. The specific services are set out in the draft service description, which is attached to the tender documents. The requirement per job profile/career level is set out in the draft price list, which is attached to the tender documents. The contract period begins with the award, but no earlier than 01.03.2027, and ends on 28.02.2030. If the contracting authority does not confirm the termination date in writing by 30.06.2029, the contract will be extended by a further year (until 28.02.2031). The actual requirement is decisive for the service calls from this contract. The final binding determination is not made with the estimated requirement that can be derived from the draft price list, so that there is no (minimum) obligation to take delivery. However, based on the decision C-23/20 of the European Court of Justice of 17.06.2021, the contracting authority will call for services from this framework contract up to a maximum value of 150% of the awarded contract value. If the total maximum value is reached during the contract period, the contracting authority is entitled to terminate the contract with immediate effect. The contractor declares that a) employer's social security contributions are paid in sufficient amounts according to legal requirements for the persons employed by him and his subcontractors, or b) the person employed to provide the service is the managing director of a company that employs at least three persons subject to social security contributions, or c) persons are employed to provide the service who do not meet the requirements of section a) or b), but for whom, nevertheless, social security contributions are paid in the amount that would have to be paid for an employee with a corresponding salary according to legal requirements (employer and employee contributions). Note: voluntary contributions paid by such a person employed do not suffice in this respect. If there are any changes in this regard, we will inform the contracting authority immediately in writing. On request, we will prove the full payment. The contractor is obliged, at the request of the contracting authority, to carry out a so-called status determination procedure with the German Pension Insurance in the specific individual case and to make the result of the examination, including the reasons for the decision, available. If the contractor uses subcontractors, he must ensure that these are also obliged, at the request of the contracting authority, to carry out a corresponding status determination procedure and to make the results, including the reasons for the decision, available to the contracting authority. All contracting authorities have agreed to take into account the corresponding budgetary resources in the budgets. The most economical offer will be awarded the contract as the first contractor. The next-ranked offer will also be awarded a contract as the second contractor (replacement contractor). This will be taken into account if the framework contract relationship with the first contractor is terminated prematurely.
