1. The subject of the order is the provision of a physical security service for persons and property on the premises of the Repair and Maintenance Section of the Rolling Stock of the Company "Koleje Mazowieckie – KM" Sp. z o.o. 2. The detailed description, scope, requirements and method of implementation of the subject of the order are specified by the Draft Contract Terms constituting Annex No. 1 to the SWZ. 3. In all entries of the SWZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the Pzp Act, the Purchaser allows the use of solutions equivalent to those described in the standards, technical assessments, technical specifications and technical reference systems indicated in the SWZ and annexes if they allow the achievement of characteristics or parameters no worse than those referred to in the SWZ and annexes. In the case of the use of equivalent solutions, the Contractor shall prove in the offer, in particular by means of the subject evidence referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the order to an equivalent extent. 4. The Purchaser requires the submission of the subject evidence referred to in paragraph 3 (if applicable). If the Contractor does not submit the subject evidence or the submitted subject evidence is incomplete, the Purchaser, in accordance with the provisions of Article 107(2) of the Pzp Act, will call on the Contractor to submit or supplement the subject evidence referred to in paragraph 3 (if applicable). 5. The Purchaser requires that the Contractor and subcontractor (in the event of a Contractor entrusting part of the order to a subcontractor) implement the order with security personnel employed under an employment contract. The method of documenting the employment of workers, the Purchaser's rights in the scope of controlling the Contractor's compliance with the requirements and the penalties for non-compliance with the specified requirements are included in the Draft Contract Terms constituting Annex No. 1 to the SWZ. 6. If the Contractor intends to invoke an official certificate, as referred to in the Act of 5 August 2025 on the certification of public procurement contractors, he is obliged to indicate this in Part II, Section A of the Single European Order Form (Annex No. 6 to the SWZ), by providing: the certificate number and designation, the full name of the certifying entity that issued the document, the validity period of the certificate and the exact scope of the basic exclusion or participation conditions to which the Contractor invokes this certificate.
