Description
1. The subject of the contract is the supply of computer equipment for the National School of the Judiciary and Prosecution. 2. The subject of the contract has been divided into 2 parts: Part 1: Servers, Part 2: Motherboard. 3. The subject of the contract (hereinafter referred to as OPZ) is detailed in Annex 2 to the SWZ. A printout containing a list of processor results in the Passmark CPU Mark test is in Annex 6 to the SWZ. 4. The method of implementing the subject of the contract is detailed in the draft contractual provisions, which constitute Annex 3 to the SWZ. 5. The ordering party reserves the right to first examine and evaluate the offers, and then qualify the Contractor, whose offer was the highest rated, in terms of the absence of grounds for exclusion and the fulfillment of the conditions for participation in the procedure - in accordance with Article 139 of the Pzp Act. 6. In cases where the contract documents indicate trademarks, symbols, patents, origin, source or a special process, characterizing specific products or services, supplied by a specific Contractor, which would lead to the privileging or elimination of some Contractors or products, this means that the ordering party cannot describe the subject of the contract in a sufficiently precise and understandable manner and this is justified by the specificity of the subject of the contract. In such a case, the ordering party allows the submission of offers with equivalent products. Any references to trademarks, patents, origin, source or a special process, should be read with the words “or equivalent”, where the criterion used to assess equivalence is the fulfillment of at least the same features (i.e. functional and user properties), as indicated in the description of the subject of the contract and technical parameters at least at the level indicated by the ordering party (in this respect, the ordering party also allows solutions better than those described by it, in particular resulting from the modernization of the technological production line). The Contractor offering equivalent products is obliged to prove in the offer, in particular by means of subject-matter evidence, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. The Contractor is obliged to provide in the offer the name of the equivalent product, the name of the manufacturer and to prove the equivalence by specifying the properties of the equivalent product, in particular by means of information from the manufacturer, e.g. product description or printouts from the manufacturer's websites or the manufacturer's catalog card or product description/specification or another subject-matter evidence. The subject-matter evidence referred to above is not subject to supplementation. 7. In cases where the ordering party describes the subject of the contract by referring to standards, technical assessments, technical specifications and technical reference systems, as referred to in Article 101(1)(2) and (3) of the Pzp Act, this means that equivalent solutions to those described are allowed, and such a reference is accompanied by the words “or equivalent”. The Contractor who refers to equivalent solutions is obliged to prove in the offer, in particular by means of subject-matter evidence, that the solution offered by him meets the requirements specified by the ordering party to an equivalent extent. The subject-matter evidence referred to above is not subject to supplementation. 8. The ordering party intends to allocate for the implementation of the contract: 222 523,00 zł gross, including: Part 1: 130 000,00 zł gross, Part 2: 92 523,00 zł gross. 9. In the subject-matter procedure, communication between Contractors and the ordering party will take place through the on-line platform ProPublico (hereinafter: “Platform”) operating at https://e-propublico.pl (details in Section 8 of the SWZ) 10. The deadline for binding the offer expires on 15.12.2026. Details in the SWZ.
