The municipality of Frensdorf (hereinafter also referred to as the “Concession Grantor” or “Contracting Authority”) is conducting a Europe-wide, transparent, and non-discriminatory procedure for the award of a service concession in accordance with the provisions of Section 4 of the Act against Restraints of Competition (GWB) and the Concessions Ordinance (KonzVgV) to select a network operator within the framework of the operator model according to No. 3.2 of the Gigabit Directive 2.0. Bidders must submit the required proof of qualifications with their offers. The Concession Grantor reserves the right to negotiate with the bidders regarding their offers or to award the respective first offer. The Concession Grantor will select the most economically advantageous offer for the award based on the evaluation criteria listed under Section 8.2. The Contracting Authority reserves the right to cancel the procurement procedure in whole or in part if no economic result is achieved or if there are other substantive reasons against an award.
