The subject of the order is the provision of a full-service service to maintain the continuous operability of the SOMATOM DEFINITION AS computer tomograph for a period of 36 months in accordance with the Price List, Annex 2 to SWZ, and the Subject of the Order, Annex 3 to SWZ, and the planned provisions of the contract, Annex 4 to SWZ. 2. The Purchaser informs that in the current procedure conducted in the open tender procedure, it envisages the possibility of applying the procedure referred to in Article 139(1) of the p.z.p. Act. The Purchaser, by applying the aforementioned procedure, will first carry out an examination and evaluation of the offers, and then carry out the subject qualification of the Contractor, whose offer was most highly evaluated in terms of the lack of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. Using a certificate instead of subject evidence. 1) The Contractor may, instead of the appropriate subject evidence indicated in the SWZ, submit or refer to a certificate, as referred to in Article 124(2) of the p.z.p. Act, in the scope of certification of non-exclusion. 2) The certificate has an effect only to the extent that it confirms the absence of grounds for exclusion required by the Purchaser in the SWZ. 3) In the scope covered by a valid certificate, the Purchaser will not request other subject evidence from the Contractor, with the exception of cases provided for in the p.z.p. Act and the Act on the certification of public procurement contractors. 4) The certificate does not release the Contractor from the obligation to submit declarations or documents required in the SWZ in the scope which is not covered by the certification or which cannot be confirmed by the certificate: a) declarations regarding circumstances arising in this procedure, in the scope of the grounds for exclusion referred to in Article 108(1)(5) of the p.z.p. Act (capital group); b) a declaration of the currency of the information contained in the JEDZ, i.e. Article 108(1)(6) of the p.z.p. Act, Article 108(1)(5) of the p.z.p. Act, c) suspension or loss of validity of the certification; d) the necessity to make non-public or non-publicly available data available in the certification database (Article 31(6) of the uoc). 5) If the Contractor indicates that it is using a certificate, the Purchaser will first verify the validity and scope of the certificate in the database of public procurement contractors. 6) If the certificate does not cover all the grounds for exclusion required in the SWZ, the Contractor will prove the remaining circumstances by submitting the appropriate subject evidence at the request of the Purchaser. 7) If the Contractor has indicated that it will use a certificate but has not provided data enabling its unambiguous identification, the Purchaser will request the Contractor to submit subject evidence on general terms. After the request, the Contractor may refer to the certificate, providing data that unambiguously identify the certificate. 8) The Contractor is responsible for unambiguously indicating the scope in which it uses the certificate. If it does not follow from the Contractor's declaration, the certificate or the data disclosed in the certification database that the certificate covers a given ground for exclusion, the Purchaser will request the submission of subject evidence in that scope. 9) If the Purchaser has doubts about the truth of the assumption arising from the certificate, in particular whether the Contractor has not misled the certifying body or whether the Contractor still meets the conditions for granting the certification, the Purchaser will apply the procedure specified in Article 128a of the p.z.p. Act. 10) In the event of a suspension of the validity of the certification or a loss of validity of the certificate, the Purchaser will request the Contractor to submit, within a period not shorter than 5 days from the date of the request, subject evidence in the scope in which the certificate was to confirm the absence of grounds for exclusion. 11) If the certification has lost its validity in whole or in part, the Contractor may not effectively use the certificate in the scope covered by the loss of validity and is obliged to prove the absence of grounds for exclusion in accordance with the SWZ and the p.z.p. Act, i.e. by submitting subject evidence. 12) In order to enable the Purchaser to verify the certificate in the database of public procurement contractors, the Contractor indicates in the JEDZ (Part II Information about the Contractor) the data enabling access to this certificate. In the event of failure to indicate the certificate in the JEDZ, the Purchaser will carry out the subject qualification on general terms, in particular by requesting the Contractor to submit subject evidence. The Contractor may also effectively refer to the certificate after being requested to submit subject evidence.
