The procedure is conducted in accordance with the provisions of the Act of 11 September 2019 on Public Procurement (Journal of Laws 2024, item 1320, as amended), hereinafter referred to as the Pzp Act. The procedure is conducted in the form of a restricted tender in accordance with Article 410(1) of the Pzp Act. The contract is classified as a procurement in the field of defence and security. The subject of the procurement is a service of a critical nature in accordance with Article 7(13) of the Pzp Act, as it is a service intended for security purposes, involving the use of non-public information. At the same time, in accordance with Article 7(36)(d) of the Pzp Act, this service is intended exclusively for military purposes. The implementation of the SUFO service on the premises of a military unit requires the Contractor to work closely with materials classified as "confidential" at a minimum. The Contractor, based on an extract from the Protection Plan of the Military Complex, is obliged to develop and implement a Protection Instruction, which in itself becomes a document containing sensitive data (e.g. the placement of posts, communication systems, procedures for responding to crisis situations). The tasks of the SUFO personnel do not limit themselves to guarding property, but also include the systematic protection of strategic objects. The Contractor processes non-public information regarding the security structure of the unit, alarm systems, and restricted access areas. Furthermore, as part of the service provided, SUFO staff protect physical access to premises and equipment where information of key importance to national defence is processed. Due to the above, the Contractor is required to have the ability to protect non-public information, which confirms the nature of the service as going beyond standard property protection services available on the civil market. The Contracting Authority does not envisage limiting the number of Contractors to be invited to submit offers. The Contracting Authority will invite all Contractors whose applications for admission to the procedure will not be rejected under Article 146(1) of the Pzp Act. The subject of the procurement is: the provision of a security service for persons and property, carried out by Special Armed Guard Formations (SUFO) on a 24/7 shift basis, for the Agency for Armaments, which is in the supply of the Contracting Authority. The Contracting Authority requires the Contractor to employ, under an employment contract, a person performing the tasks indicated by the Contracting Authority in the scope of the implementation of the contract: physical protection of persons and property, if the performance of these tasks involves performing work in a manner specified in Article 22(1) of the Act of 26 June 1974 – Labour Code. The method of verifying the employment of these persons, as well as the rights of the Contracting Authority in the scope of controlling the fulfilment by the Contractor of the requirements related to the employment of these persons, and the sanctions for non-compliance with these requirements, are contained in Annex No. 13 to the SWZ, i.e.: Draft contract terms. In the procedure for awarding the contract, communication between the Contracting Authority and the Contractors, in particular the submission of an application for admission to the procedure/offer, the exchange of information, and the transmission of documents or declarations, is carried out using electronic communication means provided by the System. The technical and organisational requirements for sending and receiving electronic documents and information transmitted using them are described in the Regulations for the use of the System's services (Regulations of the e-Services Portal) available from the E-learning module for all users of the System and during the registration of the Contractor's account for Contractors. 1) Applications for admission to the procedure/offer, declarations submitted electronically must be signed with a qualified electronic signature. In the process of submitting an application for admission to the procedure/offer, declarations, or subject evidence, the Contractor may submit a qualified electronic signature directly to the document, which is then sent to the System. The Contractor, Contractors jointly applying for the award of a public contract, in the scope of documents concerning each of them, certifies the conformity with the original. By original, a document signed with a qualified electronic signature by the authorised person/persons is meant. The certification of conformity with the original is made in electronic form, signed with a qualified electronic signature by the authorised person/persons.
