The subject of the order is the supply of control and research equipment, namely: PART 1 Separator/sieve and sieves – 1 set PART 2 Device for marking the density of grain in a loose state – 1 unit PART 3 Aluminium probe – grain sampler 2.5 50 mm and 1.5 35 mm – 1 set 2. CPV Code: 38000000-5 Laboratory, optical and precision equipment (excluding glass) 38540000-2: Testing and measuring machines and equipment Additional information – concerns each part 3. The contractor is obliged to execute the order on the principles and conditions described in the contract template constituting Annex No. 3 to SWZ. 4. The contractor will be obliged to: - transport the delivered equipment to the building of the ordering party in the city of Kielce; - bring the delivered equipment to the rooms indicated by the ordering party; - connect and start the delivered equipment – in order to demonstrate correct operation; - provide warranty service during the warranty period at the place of use of the equipment, on the terms specified in the contract. 5. The required warranty and guarantee period for the delivered equipment is specified in Annex No. 1. (Offers containing a warranty and guarantee period shorter than indicated in Annex No. 1 will be rejected). 6. The delivered equipment must be factory new, with no signs of use, must come from current production, i.e. must be produced no earlier than in 2025 and may not be the subject of third-party rights. 7. The delivered equipment should have the required by law certificates, certificates, quality certificates and meet all the requirements of the standards, specified by the applicable law, taking into account primarily its intended purpose. 8. The delivered equipment must have on the day of delivery a warranty card, operating instructions (in paper version) and all necessary documents required for this type of equipment; it should be equipped with all elements (connectors, cables, etc.) necessary for start-up and operation at the Ordering Party for the purpose for which they are purchased, without the need for the Ordering Party to purchase additional elements. 9. All documents attached to the delivered subject of the order must be prepared in Polish in printed form (operating instructions – preferred electronic version recorded on a pendrive). 10. All documents must be prepared in a way that ensures accessibility for people with disabilities, taking into account the principles resulting from: 1) Act on the accessibility of websites and mobile applications of public entities (of 4 April 2019, Journal of Laws 2019 item 848, as amended by Journal of Laws 2023 item 511); 2) Act on ensuring accessibility to persons with special needs (of 19 July 2019, Journal of Laws 2019 item 1696); 3) Accessibility standards for cohesion policy (Annex No. 2 to the Guidelines on the implementation of the principle of equal opportunities and non-discrimination, including accessibility for persons with disabilities and the principle of equal opportunities for women and men in the context of EU funds); 4) Convention on the Rights of Persons with Disabilities (adopted in New York in 2006, ratified by Poland in 2012, item 1169). A. Ordering Party's requirements regarding the conformity of ICT solutions: 1) If the subject of the order includes or may include an ICT product, ICT service or ICT process, the contractor is obliged to offer only such ICT products, ICT services and ICT processes, which on the date of submission of the offers: a) Are not indicated in the recommendation, referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of state security; b) Do not include an ICT product, the type of which has been determined in a decision on the recognition of a supplier as a high-risk supplier, referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or an ICT service or ICT process specified in that decision. 2) If the contractor offers ICT solutions, he is obliged to clearly identify in the offer each offered ICT solution, in particular by indicating: a) Name of the solution, b) Manufacturer or supplier, c) Type, model, version or other designation allowing its identification, d) Function performed within the implementation of the order. 3) The lack of possibility of unambiguous identification of the offered ICT device burdens the contractor. 4) If it follows from the content of the offer, documents submitted together with the offer or explanations of the contractor, that the offer includes a solution, referred to above in point 1 letter a) or b), the offer is subject to rejection on the basis of Article 226(1) point 17 or 19 PZP.
