The contract involves the provision of insurance services for the municipal authority and the OCMW of Ingelmunster as described in the technical specifications of this tender and inventory. The subject matter is the conclusion of insurance policies for Personal Insurance, Material Damage Insurance, Liability Insurance, and Marine Insurance in the first lot and Hospitalisation Insurance in the second lot of the contract. Pursuant to article 47 of the law of 17 June 2016, the municipality acts as the contracting authority for both entities. In accordance with the provisions of article 2, 24°, article 35, paragraph 1, 3° and article 38 of the law of 17 June 2016, regarding public procurement legislation, and the Royal Decree of 18 April 2017 on the award of public contracts in the classical sectors, the contract will be awarded by means of a competitive procedure with negotiation and Belgian and European publication. In accordance with art. 38. § 1, c and §5 the contracting authority applies the competitive procedure with negotiation, because the content and conditions of these policies cannot be accurately established under negotiation. Classification Contracts for services: CPV 66510000-8. Lot 1 of the contract is an indivisible whole but must be worked with individual policies for the requested risks. The premiums must be settled annually per entity. The start date of the policies must be set on 1 January. Lot 2 of the contract concerns only hospitalisation insurance. It is possible to submit for one of both lots or for both lots. The claims statistics for all participating authorities can be requested from the head official of the municipality and OCMW Ingelmunster, namely Mr. Christophe Pareit, via [email protected]. Insurance companies are considered as the only possible tenderers in this contract. The offers from brokers or other intermediaries will be further rejected. The offer must provide at least the following components: - Registration form fully completed and signed. - Proof of signature authority showing the authority to bind the company (extracts from the statutes, power of attorney, …). - Note regarding the additional and other guarantees per insurance. The technical specifications specify the maximum number of pages for these notes each time. Proposals whose note exceeds this number can only be considered for the specified maximum number of pages. General Conditions must be added in a separate file. The tenderer is invited, if he discovers an error in the specification or a provision that he considers irregular or makes it impossible for him to participate in this contract, to report this as soon as possible after receipt. Requests or remarks that are considered admissible by the contracting authority will be corrected and, if applicable, a possible postponement of the date of submission of the offers. Other tenderers who also received the conditions will be informed simultaneously. Each tenderer can improve his offer with a commercial discount. When tenderers, in accordance with article 50, submit a price reduction or an improvement proposal for their offer, the economically most advantageous regular offer will be determined for one or both lots, taking into account the price reductions or improvement proposals for certain grouped lots and the economically most advantageous whole of all lots. The first analysis of the offers will be made without taking these discounts into account. The commercial discounts will only be taken into account at the moment of the BAFO phase per lot as applicable as formulated by the tenderer. If a discount in the form of percentages is given, it will be calculated as follows: X % discount on the premium i.e. net premium * (1- X%) = new premium.
