Germany – Architectural and related services – Feuerwehrgerätehaus - Fachplanungsleistungen Leistungsbild TGA, HLS (Los 1) und Elektro (Los 2), LPH 8 und 9 nach HOAI

I. Suitability criteria (specific, see attachment "Minimum requirements")

Lot 1: Technical building equipment HLS in plant groups 1 — 3 as well as 7 and 8 according to §§ 53 ff. HOAI 2021

Lot 2: Technical building equipment Electrical in plant groups 4 and 5 according to §§ 53 ff. HOAI 2021

Work on the rough construction measures for the project has already begun. The commencement of the services is planned immediately after the order is placed.

1. Economic and financial suitability (specific requirements, see Minimum requirements)

a) Professional indemnity insurance (requirements, see Minimum requirements)

b) Minimum annual turnover in the last three years: 50,000.00 EUR/a in the scope of services (requirements, see Minimum requirements)

2. Technical suitability and capacity (specific requirements, see Minimum requirements)

a) one reference (requirements, see Minimum requirements)

b) at least one professional with a university degree qualifying for the profession (requirements, see Minimum requirements)

II. Declarations of honour

The following declarations of honour, which you will find in the tender documents, must be completed and signed with the offer:

1) VHB Bund 124 "Declaration of honour regarding suitability"

2) VHB NRW 521 "Declaration of honour regarding grounds for exclusion"

3) VHB NRW 522 "Declaration of honour regarding Minimum Wage Act"

4) VHB NRW 523 EU Declaration of honour Sanctions Package (Russia) - Form (does not need to be signed)

III. Review clause

The city of Schwelm reserves the right, pursuant to § 132 para. 2 No. 1 in conjunction with 132 para. 2 No. 4a GWB or pursuant to § 132 para. 2 No. 1 GWB, to offer the execution of the services to suitable bidders in the order of the tender result, who have submitted an economically acceptable offer in the tendering procedure, if the contractor finally fails due to termination or for another reason. In the event that the winner of the tender finally fails due to termination, insolvency or for another reason before the services have been fully rendered, the contracting authority reserves the right to offer the remaining work to the other bidders in the order of the tender result up to place 5. The additional costs arising from this are to be borne by the previous contractor under the aspect of substitute performance. This only applies if the resulting increase in the total price remains within the framework prescribed by § 132 para. 3 GWB.

IV. Exclusion clause

These Additional Contractual Terms shall apply exclusively. The city of Schwelm only recognises conditions of the contractor that are contrary to or deviate from these General Contractual Terms if the city of Schwelm expressly and in writing consents to their validity. These Additional Contractual Terms shall also apply if the city of Schwelm accepts or pays the delivery without reservation, even if it is aware of conditions of the contractor that are contrary to or deviate from these Additional Contractual Terms.

V. Public Sector Contracts Act (VerpflG, date of promulgation: 02.03.1974)

The Public Sector Contracts Act applies to this tender. Accordingly, contractual partners of the public sector are obliged to fulfil their obligations conscientiously.

VI. Information on legal remedies (EU)

If we do not remedy a complaint, you have the possibility to submit an application to the competent tender review body within 15 calendar days (review application).

VII. Implementation period: 06.10.2026 - Autumn 2027

VIII. Award criteria: Fee 40 percent, Qualification 60 percent
