Description
The subject of the contract is the provision of services called Collection and Disposal of Municipal Waste from property owners residing in the area of the Municipality of Iwkowa, in accordance with the applicable regulations, i.e. the Act of 14 December 2012 on Waste (i.e. Journal of Laws of 2023, item 1587, as amended), the Act of 13 September 1996 on Maintaining Cleanliness and Order in Municipalities (i.e. Journal of Laws of 2025, item 733), executive regulations to the aforementioned acts, and resolutions of the Council of the Municipality of Iwkowa adopted on the basis of the aforementioned acts. 2. These services involve the collection and disposal of municipal waste from property owners residing within the administrative boundaries of the Municipality of Iwkowa, as well as waste from properties on which holiday homes or other properties intended for recreational purposes are located. 3. In carrying out the task of collecting and disposing of municipal waste collected from the area of the Municipality of Iwkowa, the Contractor is obliged to dispose of the collected municipal waste in a manner consistent with the waste management hierarchy, as referred to in Article 17 of the Act of 14 December 2012 on Waste (i.e. Journal of Laws of 2023, item 1587, as amended), and in accordance with the applicable Voivodeship Waste Management Plan for the Małopolskie Voivodeship. 4. The subject of the contract includes loading, transporting, and neutralizing waste in regional facilities specified in the Waste Management Plan for the Małopolskie Voivodeship. 5. The detailed scope of the services, the method of contract performance, and the obligations of the contractor are specified in the following documents: - Annex No. 4 to the SWZ, i.e. Description of the Subject of the Contract (hereinafter: OPZ), and - Annex No. 3 to the SWZ, i.e. Draft Contract Terms and Conditions, including annexes. 6. The Contractor undertakes to perform the work in accordance with the scope and requirements specified in the Description of the Subject of the Contract, which is Annex No. 4 to this SWZ, with the applicable regulations and standards in this scope, the current level of technical knowledge, and the draft contract terms and conditions, as well as with due diligence. 7. In accordance with Article 95 of the pzp Act, the Contracting Authority requires, throughout the contract performance period, that the Contractor or Subcontractor employ, under an employment contract, persons performing the following activities within the scope of the performance of this contract: vehicle operation (in particular drivers and the rest of the vehicle crew operator), current handling of reports, preparation of reports, settlements, the performance of which involves carrying out work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code, with the observance of the minimum remuneration for work specified on the basis of the Act of 10 October 2002 on the minimum remuneration for work (i.e. Journal of Laws of 2024, item 1773) - calculated as of the date of the contract conclusion. In the case of employing a worker on a part-time basis, the requirement of the minimum remuneration is subject to proportional recalculation. The detailed scope regarding the obligation to employ under an employment contract, in particular issues related to the method of verifying the employment of these persons and the rights of the contracting authority in the scope of controlling the fulfillment of these requirements by the contractor, is specified in the Draft Contract Terms and Conditions - Annex No. 3 to the SWZ. 8. The Contracting Authority, before signing the contract and during its performance, has the right to control the fulfillment by the Contractor or Subcontractor of the requirement indicated in the above point, in particular by ordering a control by the State Labour Inspectorate and in accordance with the provisions of the Draft Contract Terms and Conditions, Annex No. 3 to the SWZ. 9. The Contracting Authority allows the possibility of performing the subject contract by the Contractor using subcontractors, who is obliged to indicate in section D in part II. of his own uniform document (JEDZ-a), referred to in point 9.2 of the SWZ.
