The contracting authority defines equivalence in the additional information point 21 of section VI.3). Continue from points VI. 1-3) Additional information. 15. Price list: must be submitted as part of the tender, priced, filled in with data relating to each tenderer (in the case of a joint tender, for all joint tenderers) and signed in a business-like manner by the tenderer(s) or by the authorized representative of the joint tenderers. The contracting authority draws the attention of those registering to participate to section 66 (3) of the Kbt., according to which the participant may not make a tender in the registration for participation, otherwise the registration for participation is invalid according to section 73 (3) of the Kbt. 16. In the present invitation and the KD, the Kbt. and its implementing decrees and the provisions of the Ptk. are the guidelines in questions not regulated. 17. The contracting authority does not apply the provisions of section 87 (6) of the Kbt. 18. In order to comply with the principles set out in section 2 of the Kbt. and the requirements set out in section 88 (6) of the Kbt., the contracting authority informs the GSZs that, in addition to the minimum requirements set out in point 3 of point III.4.7) "Conditions related to contract performance", it is possible to negotiate on all contractual conditions, including but not limited to the following contractual conditions (but not exclusively these conditions): liability provisions (e.g. liability limitation, its scope, penalty clauses), payment, price tracking, contract suspension, termination, guarantee-related conditions, as well as delivery deadlines. The invitation and the KD contract design contains the conditions proposed by the AK: 19. The winner of the procurement procedure is the (joint) tenderer who submits a valid tender that meets the conditions set out in the invitation to tender and the KD, and is the most economically advantageous tender according to the tender evaluation criteria. 20. In accordance with the provisions of section 1 (6) of Government Decree 63/2022. (II. 28.) on measures to reduce the number of single-tender procurements, the summary of the market consultation is available at EKR000458742026 21. It is the responsibility of the tenderer to prove technical equivalence, the appropriate proof must be submitted with the first tender as part of the technical-commercial tender. The AK provides the following information to tenderers regarding the proof of equivalence: The proof of equivalence of the offered sorbent must be carried out experimentally. The experiments must be carried out with real evaporator concentrates from the Paks Nuclear Power Plant, taking into account the parameters mentioned in the technical description of the procurement. The proof of equivalence must be carried out on the basis of a quality plan and experimental program, which contains the description of the planned experiments, the tools to be used and the measurement methods. After the experiments have been carried out, an evaluative report must be presented on the activities carried out and the results. When proving equivalence, it must be taken into account that MVM Paksi Atomerőmű Zrt. uses a liquid waste treatment technology consisting of several technological steps to handle the evaporator concentrates, as follows: The radioactive cesium isotopes, which make up a significant part of the radioactivity of the evaporator concentrates, are removed in the 3rd step of the technology. Prior to this, in the first step, the organic content of the evaporator concentrates is decomposed, and then in the second step, immediately before the application of the cesium-selective sorbents, the colloidal-sized contaminants are removed by ultrafiltration. The AK only provides the necessary amount of liquid radioactive waste for the proof of equivalence, without carrying out the removal of organic matter or ultrafiltration, and does not provide the other conditions necessary for the implementation of the experimental program. The AK takes back the secondary radioactive waste generated during the proof of equivalence at the contracting authority's site. The activity content of the returned waste must not exceed the activity content of the transmitted radioactive waste sample and must not deviate from its isotopic composition. The proof of this must be documented and verified by measurements, which is the responsibility of the tenderer. The contracting authority draws up a record of the success/failure of the proof of equivalence, which it hands over to the tenderer. Approval process: After the proof of equivalence has been successfully qualified by the contracting authority, a conversion permit must be obtained from the OAH for the application of the offered sorbent in the technological system. The contracting authority continues the official approval process and bears the costs associated with the conduct of the process. It is the responsibility of the tenderer to prepare the documentation necessary for the official approval. The approval documents must be prepared in accordance with the relevant OAH guidelines and the design specifications of MVM Paksi Atomerőmű Zrt., which MVM Paksi Atomerőmű Zrt. will make available to the tenderer upon request. The approval documentation must demonstrate that the offered sorbent is suitable for use in the existing technological equipment, is compatible with the tools set up for handling the sorbents used, including the presentation of the radiation conditions arising during use. The GSZ/participant/tenderer may not claim costs from the contracting authority in relation to the proof of equivalence and/or the preparation of the approval documentation during the procedure.
