Poland – Stadium construction work – „Wykonanie w trybie zaprojektuj i wybuduj zadania inwestycyjnego pn. "Budowa kompleksu stadionu miejskiego w Chorzowie”

The subject of the contract is the multi-stage implementation of the municipal stadium complex in Chorzów, as part of the task entitled „Construction of the municipal stadium complex in Chorzów” – to be carried out in the form of „design and build”, in accordance with which the Contractor undertakes to prepare the design documentation, obtain the necessary administrative decisions, and then carry out the construction works on the basis of the documentation. 2. The subject of the contract is to be implemented in stages, in a manner ensuring the uninterrupted operation of the stadium throughout the entire construction process, in particular enabling the organisation of football matches in accordance with the applicable regulations on mass events and the requirements of the licensing manual for Ekstraklasa clubs after the completion of Stage I. 3. The implementation of the subject of the contract is to be carried out in such a way that the Contractor prepares a building design covering the entire stadium complex and obtains a building permit for the entire complex on this basis, taking into account the design and implementation of construction works in a phased manner. After the completion of Stage I, the Contractor will obtain the appropriate administrative decisions (building permit for the scope covered by Stage I). Stage I must be designed and implemented in a manner ensuring the possibility of conducting sports events, including football matches, at the facility, meeting the minimum licensing requirements of the PZPN for Ekstraklasa competitions, in particular in terms of: stadium capacity, safety and monitoring systems, sound reinforcement, lighting, media infrastructure, VAR system and socio-technical facilities for players, referees, media and fans. 4. The Contractor must provide a complete set of documents, agreements and formal legal procedures enabling the commissioning of parts of the facility (in stages), in accordance with the provisions of the Building Law and the requirements of the competent building supervision authority, in particular in terms of partial acceptance, installation permits, safety systems and technical infrastructure necessary for the legal use of the facility at the given Stage. 5. For each stage, it will be necessary to develop and agree with the Contracting Authority a detailed plan for ensuring the continuity of the stadium's use, containing a time schedule and temporary solutions (including communication, media availability, evacuation, securing areas for fans and players). 6. Each of the subsequent stages of implementation must end with a state enabling the use of the facility in accordance with its intended purpose and the continuation of construction works in a manner that does not disrupt the operation of the stadium. At each stage of implementation, the Contractor is obliged to ensure the continuity of safe use of the stadium within the scope permitted for the given stage and to meet the requirements arising from the regulations on the safety of mass events, fire protection, evacuation, accessibility and – within the scope required for the given stage – the licensing requirements of the PZPN and UEFA. The Contractor is not entitled to any claims arising from organisational, technical or logistical difficulties resulting from the staging of the implementation of the investment. The Contractor has taken into account the staging in the price of the offer. 7. The subject of the contract is divided into the following Stages: 7.1. Stage I 7.1.1. Stage I includes the implementation of the main (club) stand with the necessary technical and functional infrastructure and the club building, as well as the implementation of infrastructure enabling the use of the stadium for organising football matches in accordance with the applicable regulations on the safety of mass events and the licensing requirements of the PZPN 7.2. Stage II 7.2.1. Stage II includes the design and implementation of the second stand - side with the necessary technical infrastructure and the development of the adjacent area. 7.3. Stage III 7.3.1. Stage III includes the design and implementation of the third stand - with the largest number of seats with full accompanying infrastructure, ensuring the achievement of the target capacity of the stadium and meeting all the licensing requirements of the PZPN for Ekstraklasa and UEFA (cat. III) competitions. 7.4. Stage IV 7.4.1. Stage IV includes the design and implementation of the fourth stand - side with the necessary technical infrastructure and the development of the adjacent area. 7.5. Stage V 7.5.1. Stage V includes the design and implementation of the final development of the entire stadium complex area in the scope ensuring full functionality, safety and accessibility, in accordance with the adopted architectural and functional concept, Functional-Use Programme and the requirements of the law.
