Bulgaria – Road construction works – Определяне на изпълнител за изработване на технически проект и строителство на обект: „Трайно укрепване на републикански път II-58 „(Конуш-Черноочене) – Комунига“ при км 4+350, област Кърджали

The subject of this public procurement is „Determining the contractor for the design and construction of the object: „Permanent strengthening of the national road II-58 „(Konush-Chernoochene) – Komuniga“ at km 4+350, Kardzhali Region“. The objective of the public procurement is to determine a contractor for the preparation of the Technical Project, exercise of author's supervision during construction and performance of construction and installation works (C&I) (engineering) of the object, in connection with the implementation of the permanent strengthening of the national road II-58 „(Konush-Chernoochene) – Komuniga“ at km 4+350, and to conclude a contract for its implementation, in order to prepare a lawful Technical Project, which will serve for the implementation of quality construction of the object, in accordance with the normative requirements and observance of the agreed deadlines. Pursuant to Art. 137, para. 1, item 1, letter "a" of the SPA, the construction is of the first category. Pursuant to Art. 5, para. 1, item 2 of the Ordinance on the procedure for registration and maintenance of the Central Professional Register of Builders, issued by the Chamber of Builders in Bulgaria, the construction is of the second group: constructions of the transport infrastructure. In the performance of the obligations under the concluded contract, the Contractor will perform the following activities: A) Activity „Design“ – performance of design works (DW): A1. Performance of the necessary survey works and preparation of the Technical Project, in accordance with the requirements of the Employer and the requirements of the currently applicable normative documents, in the volume and content determined in the Design Assignment (Appendix A to the Engineering Contract) and in accordance with the deadline for the performance of DW under the Contract. A2. Obtaining of the initial data for design from the interested central and local administrations, as well as from all the companies operating in the territory of Kardzhali Region. A3. In case of detection of an obvious factual error in the cadastral map and cadastral registers and in the maps of the restored property of the affected plots the Contractor shall prepare and submit a Project for amendment of the cadastral map and cadastral registers. A4. Performance of all the necessary agreements of the Technical Project with the operating companies and administrations, whose permission, assistance or opinion is necessary for the implementation of the subject of the public procurement. A5. The Technical Project should be in compliance with the legislation in the field of environmental protection and cultural heritage and, if necessary, to conduct a procedure in accordance with the environmental legislation, to be supplemented with the recommendations thereof. A6. Elimination (at the expense of the Contractor) of the deficiencies of the Technical Project, established in the course of the performance of the contract and/or during the checks by the Employer and/or the person exercising the construction supervision, performing and assessment of the compliance of the project with the essential requirements for the constructions and technical control under the „Constructive“ part, in accordance with the SPA, including during the approval of the project and issuance of a building permit by the competent authority under the SPA, as well as during the construction. A7. With the preparation of the Technical Project by the Contractor, a Quantity – Cost Estimate (QCE) is compiled, which is approved by the Consultant after the approval of the Technical Project. QCE is submitted to the Employer within 30 (thirty) calendar days from the approval of the Technical Project, together with the written opinion of the Consultant under the Contract, in which the Consultant's unconditional statement for approval of QCE and the unit prices included therein is reflected. The total value of QCE may not exceed the Price for the performance of C&I, excluding Unforeseen Expenses. All works and activities, included in the Technical Project, but omitted from the estimate are at the expense of the Contractor. A8. QCE is costed with unit prices, which are also subject to approval by the Consultant and are formed on the basis of analysis, and in accordance with the elements of price formation, indicated in the Price Proposal of the Contractor, as follows: - hourly rate euro/hour; - additional labour costs %; - additional mechanization costs %; - delivery - storage costs %; - profit %. A9. Undertaking responsibility for the quality of the project during the implementation of the construction, as at the conclusion of the contract the Contractor shall provide the Employer with a guarantee for the performance of the contract. B) Activity „Author's Supervision“ - exercise of author's supervision during the construction (AS): B1) Performance of the obligations as a designer, during the construction, in accordance with the current Bulgarian legislation (Order No. 3 of 31.07.2003 of the MRRB for the preparation of acts and protocols during the construction and Order No. 2 of 31.07.2003 of the MRRB for the commissioning of the constructions in the Republic of Bulgaria and minimum guarantee periods for completed construction and installation works, facilities and construction objects), including the exercise of author's supervision in accordance with Art. 162, para. 2 of the SPA during the construction. B2) The Contractor undertakes to make the necessary number of visits to the site in order to implement Order No. 3 of 31.07.2003 for the preparation of acts and protocols during the construction, and in accordance with the applicable normative acts and the conditions of the contract, as well as in case of arising questions regarding the Technical Project in the process of construction. B3) The Contractor undertakes to attend the monthly meetings, which will be held during the construction with the participation of representatives of the Employer, the construction supervision and the Builder. B4) The Contractor undertakes to comply with the Technical Project prepared by him, to enter his instructions in the order book, as well as to participate in the acceptance commissions of the object.
