The total enterprise budget is carried out as a negotiated procedure in accordance with the Public Procurement Act §§ 61-66 with a prior pre-qualification. The contracting authority reserves the right not to conduct a negotiation and thus to award the contract based on the initial tender in accordance with point IV.1.5 of the tender notice. A tender fee of 150,000 DKK excl. VAT is paid to the tenderers who submit initial tenders that meet the submission requirements and who are not awarded the contract. An additional fee of 50,000 DKK excl. VAT is paid to the tenderers who participate in the negotiation and who submit final tenders but are not awarded the contract. The award criterion is "The best price-quality ratio" in accordance with the Public Procurement Act § 162, subsection 1, no. 3. The total enterprise tender is carried out after prior pre-qualification. Among the pre-qualification applicants, 4 teams are selected to be invited to submit tenders. As part of the pre-qualification, the contracting authority wishes to ensure a varied field of applicants and consortium composition. The tender phase begins with a joint inspection of the existing buildings and outdoor areas. Tenderers will have the opportunity to participate in a voluntary dialogue meeting with the contracting authority with a view to discussing the intended architectural main features of the tender. The purpose of the meeting is to give the bidders the opportunity to clarify any questions and gain an updated understanding of the architectural framework and intentions. The contracting authority will not evaluate the qualitative sub-criteria before, during or after the meeting, and therefore the tenderers will not receive a position on the concrete project. After the dialogue meetings, the tenders are finalised and submitted via the project web. The tenders are then assessed by an assessment committee consisting of representatives from the contracting authority's organisation, construction client advisors and external experts. Based on the assessment, the contracting authority decides whether to conduct a negotiation round, or whether the task is awarded directly based on the initial tenders, which in this case become the tenderers' final tenders. Regardless of whether a negotiation is conducted or not, tenderers, after submission of the initial tenders, will be invited to individual presentation meetings, where their tender is presented to an assessment committee consisting of representatives from the contracting authority's organisation and external experts and possibly fund representatives. Based on the presentation meetings and subsequent assessment of the tenders, the contracting authority makes a decision on whether to conduct a negotiation round, or whether the contracting authority will make use of the possibility to award the contract based on the initial tenders, which herewith will become the tenderers' final tenders. The tender phase concludes with the issuance of the evaluation and designation of a winner. After the standstill period has expired, the contracting authority intends to enter into total enterprise agreements with the winning tenderer, who best fulfils the award model for the tender phase. Exclusion: An economic operator is excluded from participation if the economic operator is covered by one of the mandatory exclusion grounds in the Public Procurement Act § 135, subsection 1-3 and § 136, subsection 1, no. 1-3. Furthermore, an economic operator is excluded from participation if the economic operator is covered by the voluntary exclusion grounds in the Public Procurement Act § 137, subsection 1, no. 1) and 2). An economic operator may not be excluded from participation if the economic operator submits sufficient documentation that the economic operator is reliable, even if the economic operator is covered by one or more of the exclusion grounds in the Public Procurement Act §§ 135-137, in accordance with the Public Procurement Act § 138, subsection 1. Council Regulation (EU) 2022/576 Contracts cannot be awarded to the following companies, in accordance with Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine: A. Russian nationals or natural or legal persons, entities or bodies, established in Russia B. legal persons, entities or bodies, of which a unit as referred to in this paragraph, litra a) directly or indirectly owns more than 50 %, or C. natural or legal persons, entities or bodies, which act on behalf of or upon the instructions of a unit as referred to in this paragraph, litra a) or b). Likewise, subcontractors or supporting units, which are covered by the above, cannot be used if this actor's contribution amounts to more than 10 % of the contract value.
