Description

The subject of this insurance tender is a liability excess (general liability insurance) for damages within the scope of the general liability insurance for the construction project “2. S-Bahn-Stammstrecke München” of the contractors DB InfraGo AG and DB Energie GmbH, which, with its own inspection right of the excess insurer, is based on the conditions of a basic insurance on the basis of a Combined Construction, Erection, Liability Insurance® Following-Form, without Step- or Drop-down regulation. All companies commissioned by the contractor with the planning, supervision and execution of this construction project are co-insured (without planning liability insurance). The insurance cover to be provided relates to the construction project 2. S-Bahn-Stammstrecke München, i.e. the construction of a double-track S-Bahn line in the Munich city centre, starting at Laim station and ending at Leuchtenbergring station (both above ground), with the intermediate underground stations Hauptbahnhof, Marienhof and Ostbahnhof, single-track tunnel sections, connecting tunnels and rescue shafts. In the course of the implementation of the construction measure, further additional construction measures with mutual construction-time, construction-technical and local dependency are implemented: • Advance measure U9 at Hauptbahnhof station • Interim measure Hauptbahnhof, partial demolition, site clearance. The provisional insurance sum for the basic insurance is EUR 9.4 billion. The contract period of this liability excess insurance begins after the completion of the tendering procedure with the award of the contract. It ends fixed on 31.03.2031. There is an extension option of 2 years until 31.03.2033. In the basic cover, a liability insurance sum of EUR 25 million per damage case is available in total for personal, property and financial losses, 5 times maximised. The subsequent liability period in the general liability insurance is 5 years. Following the basic insurance, the liability excess provides insurance cover within the scope of the liability-relevant conditions of the basic insurance. This means that the insurer's obligation to perform from the liability excess relates to the part of the damage that follows the cover sum of the basic insurance, i.e. EUR 25 million after the cover sum of the basic cover of EUR 25 million, once maximised (EUR 25 million after EUR 25 million, 1 times max.), without Drop-/Step-down. There is no insurance cover for services of the basic insurance for which a sublimit has been agreed, in particular not for asbestos/urea/formaldehyde. The insurer of the liability excess insurance has its own right to inspect damages, independent of the decision of the basic insurer.
