Poland – Information and promotion products – Wykonanie i dostawa elementów stoiska informacyjno-prezentacyjnego opartego na potencjale turystyczny, w tym turystyki rowerowej Małopolski

The subject of the contract is the execution and delivery of elements of an information and presentation stand relating to tourism (including cycling) in Małopolska. The stand should be a coherent, aesthetic and functional space enabling the presentation of the values and potential of tourism, including cycling tourism, in the region.

2. The contract will be awarded in 2 parts.

3. The contract for part 1 includes the execution and delivery of the following information and presentation stand elements: advertising balloon, roll-up, spider tent, puff chair, barrier cover, wind flag, textile wall, advertising cassette, pneumatic gate, set of transport boxes, advertising sandwich and advertising block. The contract for part 2 includes the execution and delivery of the following information and presentation stand elements: external single-sided multimedia totem, internal double-sided multimedia totem and set of LED screens.

4. The detailed description of the subject of the contract (SOPZ) for part 1 is contained in annex 1D.1 to the SWZ, and for part 2 in annex 1D.2 to the SWZ and will be introduced as annex 1 to the public contract for the given part.

5. The terms of contract execution are contained in the draft provisions of the public contract, which will be introduced into the public contract – contract template and constitute annex 1C to the SWZ (hereinafter referred to as the contract template).

6. The Contracting Authority provides for each part of the contract the possibility of exercising the right of option, referred to in Article 441 of the Act, consisting in increasing the scope of the subject of this contract by instructing the Contractor to execute and deliver additional elements of the information and presentation stand, as referred to in the SOPZ for the given part (i.e. for part 1 in annex 1D.1 to the SWZ, and for part 2 in annex 1D.2 to the SWZ).

7. The description and rules for the exercise of the right of option are given in the contract template constituting annex 1C to the SWZ.

8. The value of the contract within the scope of the right of option has been set at the following amounts, excluding VAT: for part 1: 88 147,20 PLN, and for part 2: 86 297,48 PLN.

9. In cases where the contract description specifies requirements relating to the technical or functional properties of products by reference to specific standards, certificates, certificates, etc., the Contracting Authority allows the offer of equivalent products, provided they meet the requirements indicated in the contract description and ensure at least an equivalent level of the required properties, including those relating to user safety and fire safety, if applicable. The Contractor who offers a product meeting the requirements on the basis of a standard, certificate, certificate, etc. other than that indicated in the contract description, is obliged to prove the equivalence of the offered solution, in particular in terms of the required technical, functional and safety parameters, by means of appropriate evidentiary means, such as certificates, test reports or other documents confirming the compliance with the required parameters. The evidentiary means shall be submitted upon request of the Contracting Authority, within the time limit indicated by it, provided that the obligation to submit them upon request has been provided for in the contract documents and is consistent with the provisions of the Public Procurement Act. The Contracting Authority allows evidentiary means issued or prepared by appropriate, equivalent units assessing compliance. In cases where the Contractor, for reasons beyond his control, cannot obtain the required certificates or test reports within the appropriate time limit, the Contracting Authority may accept other appropriate evidentiary means, in particular the technical documentation of the manufacturer, provided that this is permitted by the provisions of the law and the contract documents, and the evidence presented allows the requirements specified in the contract description to be demonstrated.

10. The value of the contract is 348 889,36 PLN (excluding VAT), including the value of part 1 is 176 294,40 PLN, where the option has been set at a value of 88 147,20 PLN; the value of part 2 is 172 594,96 PLN, where the option has been set at a value of 86 297,48 PLN.

11. The contract in each part shall be executed within 30 days from the date of conclusion of the contract.
