1. The subject of the contract is the provision of physical security services for persons and property on the premises of the Repair and Maintenance Section of the Rolling Stock of the company "Koleje Mazowieckie – KM" Sp. z o.o. 2. The detailed description, scope, requirements and method of implementing the subject of the contract are specified in the Draft Contract Terms constituting Annex 1 to the SWZ. 3. In all entries of the SWZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Article 101(4) of the Pzp Act, the Contracting Authority allows the use of solutions equivalent to those described in the standards, technical assessments, technical specifications and technical reference systems indicated in the SWZ and annexes, if they allow for characteristics or parameters no worse than those referred to in the SWZ and annexes. In the case of using equivalent solutions, the Contractor shall prove in the offer, in particular by means of the subject evidence means referred to in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 4. The Contracting Authority requires the submission of the subject evidence means referred to in paragraph 3 (if applicable). If the Contractor does not submit the subject evidence means or the submitted subject evidence means are incomplete, the Contracting Authority, in accordance with the provisions of Article 107(2) of the Pzp Act, will call on the Contractor to submit or supplement the subject evidence means referred to in paragraph 3 (if applicable). 5. The Contracting Authority requires that the Contractor and subcontractor (in the event of the Contractor entrusting part of the contract to a subcontractor) implement the contract with security personnel employed under an employment contract. The method of documenting the employment of personnel, the Contracting Authority's rights in the scope of controlling the Contractor's compliance with the requirements, and the penalties for non-compliance with the specified requirements are included in the Draft Contract Terms constituting Annex 1 to the SWZ. 6. If the Contractor intends to invoke an official certificate, as referred to in the Act of 5 August 2025 on the certification of public procurement contractors, it is obliged to indicate this in Part II, Section A of the Uniform European Tender Document (Annex 6 to the SWZ), providing: the certificate number and designation, the full name of the certifying entity that issued the document, the validity period of the certificate, and the exact scope of the exclusion bases or participation conditions, in relation to which the Contractor invokes this certificate.
