Poland – Acoustic devices – Dostawa sprzętu AV w celu zagospodarowania przestrzeni tarasu Młynów Rothera: Dostawa systemu nagłośnieniowego wraz z mikrofonami przewodowymi oraz niezbędnym okablowaniem

The subject of the order is: „Delivery of AV equipment for the development of the terrace space at Młynów Rothera: Delivery of a sound system with wired microphones and necessary cabling” within the scope and on the terms specified in the Specifications of the Order Terms (SWZ) together with the attachments, including the attachment entitled „Description of the Subject of the Order”. 2. The ordering party provides for the submission of subject-specific evidentiary means (for selected positions of the assortment listed in the Description of the Subject of the Order), i.e. producer documents (e.g. descriptions, folders, technical data sheets, user instructions), confirming that the offered devices meet the requirements and comply with the parameters specified by the ordering party in the attachment to the SWZ entitled „Description of the Subject of the Order”. The ordering party informs that, on the basis of art. 107 para. 2 of the Public Procurement Law (uPzp), it will call for the submission or supplementation of the subject-specific evidentiary means within the specified deadline, if the contractor does not submit the subject-specific evidentiary means or the submitted subject-specific evidentiary means are incomplete. 3. SOURCE OF FINANCING: Project No. FEKP.05.01-IP.02-0003/24 entitled „ADAPTATION OF MŁYNÓW ROTHERA IN BYDGOSZCZ FOR EDUCATIONAL AND CULTURAL PURPOSES – STAGE IV – 1”, co-financed from the European Regional Development Fund under the programme European Funds for Kujaw and Pomerania 2021-2027, Action 5.1 Support for cultural institutions BydOF-IP TASK 1 – Purchase and installation of stage, multimedia and typical equipment and small architecture elements for the development of the space of Młynów Rothera. 4. CERTIFICATES. (REGISTRATION OF CERTIFICATES – PAGE 12 SWZ. The subject-specific evidentiary means indicated in Section X may be replaced by a valid certificate of the contractor of public orders, as referred to in art. 124 para. 2 of the uPzp, exclusively to the extent to which the certificate confirms the absence of grounds for exclusion or the fulfilment of the conditions for participation in the procedure (if the conditions have been specified in the procedure) to the extent corresponding to the requirements specified in the SWZ. The certificate does not replace the subject-specific evidentiary means relating to the grounds for exclusion not covered by the certification, in particular art. 108 para. 1 point 6 of the uPzp, art. 109 para. 1 point 6 of the uPzp, art. 7 para. 1 of the Act of 13 April 2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, as well as circumstances arising in the course of this procedure. 1. The certificate replaces the subject-specific evidentiary means exclusively to the extent covered by the valid certification and indicated by the contractor in the declaration referred to in art. 125 para. 1 of the uPzp. If the certificate covers only part of the grounds for exclusion or part of the condition (if the conditions have been specified in the procedure) for participation in the procedure, or confirms the fulfilment of the condition at a lower level than required in the SWZ, the contractor submits the subject-specific evidentiary means in the remaining scope. 2. Within the scope resulting from the valid certificate, the ordering party does not require from the contractor other subject-specific evidentiary means, with the reservation of art. 124 para. 4 of the uPzp and art. 31 para. 6 of the Act on the certification of contractors of public orders. 3. In accordance with art. 126 para. 1 of the uPzp, the ordering party, before selecting the most advantageous offer, will call upon the contractor whose offer has been most highly evaluated to submit, within the specified deadline, not shorter than 10 days from the date of the call, the current subject-specific evidentiary means indicated in Section X, to the extent to which they have not been replaced by a valid certificate of the contractor of public orders, with the following provisions: 1) If it follows from the preliminary declaration, as referred to in art. 125 para. 1 of the uPzp, that the contractor will use a certificate, and the contractor has provided the data required in art. 273 para. 2 of the uPzp, the ordering party will independently verify the certificate in the certification database and will not call upon the contractor to submit the subject-specific evidentiary means to the extent to which the circumstances required by the ordering party result from that certificate, in accordance with art. 274 para. 4 of the uPzp, 2) If the certificate does not cover all the circumstances required by the ordering party, the ordering party will call upon the contractor to submit the subject-specific evidentiary means exclusively to the extent not covered by the certification, 3) If the data indicated by the contractor do not allow the certificate to be found or verified in the certification database, the ordering party may call upon the contractor to submit, supplement, correct or explain those data on the terms specified in art. 128 para. 1 or 4 of the uPzp. If, despite the call, the ordering party is not able to verify the certificate, the certificate will not be taken into account to the extent which cannot be verified, 4) If the data necessary for the assessment of the circumstances confirmed by the certificate have not been disclosed in the certificate or in the certification database due to their legally protected nature, the ordering party may require the contractor to make those data available or to express consent to their being made available to the ordering party by the certifying entity, on the basis of art. 31 para. 6 of the Act on the certification of contractors of public orders. The ordering party, on the basis of art. 128a para. 1 of the uPzp, will call upon the contractor to submit explanations within the specified deadline, not shorter than 5 days from the date of the call. If the ordering party considers the contractor's explanations to be insufficient, it will apply art. 128a para. 2 of the uPzp. DUE TO THE LIMITED NUMBER OF CHARACTERS IN THE INDIVIDUAL FIELDS OF THE ORDER NOTICE, THE ORDERING PARTY REQUIRES DETAILED FAMILIARISATION WITH THE SWZ AND OPZ.
