Description

The subject of the contract (under the basic contract) is the provision by the Contractor to the Contracting Authority of comprehensive, permanent, 24-hour physical protection of persons and property within the "EC1 Łódź – Miasto Kultury" complex in Łódź, which includes the following elements: 1) protection of buildings and areas; 2) protection of exhibits; 3) cash escort; 4) cloakroom service; 5) support for the intervention team. 2. The detailed scope and subject of the contract, as well as the requirements of the Contracting Authority regarding the method of implementation, are specified by: 1) Detailed description of the subject of the contract (hereinafter also “DOSC”) – Annex 1 to the Contract Notice, 2) Draft contract terms (hereinafter also “DCT”) – Annex 2 to the Contract Notice. All requirements specified in the tender documents (including those mentioned above) are minimum requirements, and their fulfillment is mandatory. Failure to meet the above minimum requirements will result in the rejection of the offer as non-compliant with the contract conditions under art. 226 (1) (5) of the Public Procurement Act. 3. Due to the nature of the object to be protected, the Contractor will be obliged to implement the subject of the contract with the involvement of security personnel constituting the staff of all shifts, possessing psycho-physical predispositions and the ability to perform the assigned duties, in particular intervention actions, responding to threatening situations, and implementing alarm and evacuation procedures, according to the specificity of the object and its character. 4. The Contracting Authority does not reserve the right to require the Contractor to personally perform key tasks related to the contracts for services. 5. The Contractor is obliged to implement the subject of the basic contract as well as the right of option from 10 November 2026 at 7:00 a.m. to 10 November 2027 at 7:00 a.m. Reason: The determination of the contract implementation period by indicating specific daily dates results from objective reasons related to the nature and specificity of the subject of the contract. Due to the nature of the protected objects and the need to ensure the safety of persons and property, the service must be provided continuously, without the possibility of a break between successive contracts. The start date of the contract implementation – 10 November 2026 at 7:00 a.m. – corresponds to the expiry date of the currently valid contract, which enables the contractor selected in this procedure to take over the obligations directly. For the same reasons, the Contracting Authority has set the end date of the contract implementation for 10 November 2027 at 7:00 a.m. This date constitutes a fixed boundary date of the cycle of security service provision adopted by the Contracting Authority. In the event of an extension of the procedure and the conclusion of the contract after the planned start date of the service provision mentioned in paragraph 5, the implementation of the contract subject will commence on the day following the day of its conclusion, while the end date will remain unchanged. The above circumstances, resulting from the continuous and 24-hour nature of the service and the need to ensure uninterrupted protection of persons and property, constitute an objective reason justifying the determination of the contract execution period by indicating daily dates, in accordance with art. 436 (1) of the Public Procurement Act. 2) The Contracting Authority will be entitled to exercise the right of option throughout the period indicated in paragraph 5, to the extent specified in the DOSC, which will each time be the result of the Contracting Authority submitting an appropriate statement of intent, whereby the Contracting Authority may submit such a statement each time no later than 48 hours before the start of the planned cultural event (event).
