4.1. /numbering consistent with SWZ/ The subject of the contract is: the purchase, delivery, installation and commissioning of a hardware environment with operating systems consisting of a virtualization cluster, disk array and SAN switches for the Project entitled: „City Management based on Spatial Databases along with the development of e-services” co-financed from the European Regional Development Fund as part of the regional programme European Funds for Łódź 2021 – 2027, which involves: • Delivery of 6 identical servers that will operate in a high-availability cluster, • Delivery of 2 identical redundant SAN switches, • Delivery of 1 disk array, • Installation of devices supplied by the Contractor in the racks indicated by the Purchaser. Installation of software, configuration, commissioning of the delivered environment and migration from the existing environment. Correct commissioning of the Devices. Execution of post-completion documentation. Conducting practical training on the operation of the purchased solution. 4.2. The offered devices must be factory new, intended for sale on the European market (in accordance with the Act of 30.08.2002 on the conformity assessment system (Journal of Laws of 2023, item 215) and the regulations issued on its basis), produced no earlier than 6 months before the delivery date and covered by the warranty required by the Purchaser, and the warranty service is authorized by the manufacturer of the devices and software and provided by the manufacturer or authorized partners in service centers within the European Union. 4.3. The hardware must come from a distribution channel in the EU authorized by its manufacturer and must not be encumbered with previously acquired rights of third parties and must be intended for sale and service on the Polish market. 4.4. The offer must include a complete set of product catalog numbers and all its additional components enabling their unambiguous identification by the manufacturer of the equipment. 4.5. Delivery of devices includes comprehensive implementation of the order, in particular: • transport, delivery and placement of devices, • installation in the racks indicated by the Purchaser, • installation, commissioning and full configuration in accordance with the requirements of the Purchaser, • migration of data and services from the existing environment, • selection, delivery and installation of complete cabling necessary for the proper operation of the infrastructure. 4.6. All the above activities are an integral part of the delivery of the devices and must be included in the offer price. 4.7. The Purchaser reserves the right to verify the legality of the delivery directly with the Polish representative of the manufacturer, in particular the validity and scope of the licensing and warranty rights. 4.8. Before delivery, the hardware and software must be registered by the manufacturer, directly to the Purchaser as the sole user upon leaving the factory. If the manufacturer does not conduct equipment registration, a declaration from the manufacturer that the equipment is factory new is required. 4.9. The detailed description and scope of the subject of the order (hereinafter: „OPZ”) is described in Annex No. 1 to the SWZ. 4.10. The Contractor is obliged to implement the order on the principles and conditions presented in the model Contract constituting Annex No. 4 to the SWZ. 4.11. The Contractor is obliged, for the entire period of the service, to have civil liability insurance and, on the date of signing the contract, to submit to the Purchaser proof of its conclusion, the conditions of the insurer's liability and proof of payment of the premium. 4.12. The order will be implemented in accordance with the „Item-Financial Schedule”, which will be finally agreed by the Parties to the contract within a period not exceeding 10 working days from the day following the date of signing the contract. 4.13. The implementation of the order must be carried out with due care and in accordance with all the requirements contained in the SWZ with annexes and any Information for Contractors. The Contractor, at the stage of implementing the order, executes the subject of the order in accordance with the requirements of the Purchaser. 4.14. Offers must be unambiguous and comprehensive, i.e. cover the entire subject of the order. The Contractor is obliged to submit an Offer, the content of which will allow the Purchaser to verify the offer in terms of its compliance with the content of the SWZ. The content of the Contractor's Offer must correspond to the content of the order specification – descriptions of the subject of the order.
