Poland – Disposable non-chemical medical consumables and haematological consumables – DOSTARCZANIE ZESTAWÓW DO POBIERANIA I ANALIZY KRWI

1. The subject of the contract is the delivery of blood collection and analysis kits to the Purchaser's headquarters (ul. Złotej Jesieni 1, Kraków), in accordance with the description and requirements set out in Annex 1 to this Specification. 2. The validity period / warranty period of the subject of the contract may not be shorter than 12 months from the date of delivery. 3. The Contractor undertakes to conduct, at the request of the Purchaser, training for the Purchaser's staff at its headquarters (ul. Złotej Jesieni 1, Kraków) together with the first delivery of goods to the Hospital Pharmacy within the timeframe agreed in writing with the Purchaser, but no later than 30 days from the date of signing the contract. 4. The Contractor shall submit a list of attendance from the training referred to in point 3, with the signatures of the trained users confirming their actual attendance to the Hospital Pharmacy, within 5 working days from the date of the training. 5. The Purchaser reserves the right to request samples of the subject of the contract from the Contractors at the stage of examining and evaluating offers in order to test them and verify the Contractor's technical or professional capability to implement the contract. The costs associated with this shall be borne by the Contractor. 6. The remaining conditions of the contract are specified in the draft contract, which is Annex 3 to the Specification. 1. Contractors who meet the conditions specified in Article 57 of the Pzp Act and Article 112(2) of the Pzp Act may apply for the contract, i.e.: 1) are not subject to exclusion 2) meet the participation conditions, regarding: a) the ability to operate in economic turnover The Purchaser does not specify a detailed condition for participation in the Procedure. b) the authorisation to carry out a specific economic or professional activity The Purchaser does not specify a detailed condition for participation in the Procedure. c) the economic or financial situation The Purchaser does not specify a detailed condition for participation in the Procedure. d) technical or professional capability The Purchaser does not specify a detailed condition for participation in the Procedure. Contractors who are not subject to exclusion from the procedure under Article 108 of the Pzp Act and Article 109(1)(1) and (4) of the Pzp Act and are not subject to exclusion from the procedure under Article 7(1) of the Act of 13 April 2022 on special solutions to counter the support for aggression against Ukraine and serving to protect national security (Dz.U. from 2022 item 835), and are not subject to a ban on awarding or further executing any public contracts under Article 5k(1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.07.2014, p. 1, as amended) may participate in the Procedure. In terms of demonstrating compliance with the conditions specified in Article 57 of the Pzp Act, the Contractor submits: a) a declaration of compliance with the conditions for participation in the procedure – signed appropriately by the person (persons) authorised to represent the Contractor. The relevant declaration, the Contractor submits in the form of a single document, which is Annex 4 to the Specification (form JEDZ); In terms of confirming the absence of grounds for exclusion from the Procedure in the circumstances referred to in Article 108 of the Pzp Act and Article 109(1)(1) and (4) of the Pzp Act and Article 7(1) of the Act of 13 April 2022 on special solutions to counter the support for aggression against Ukraine and serving to protect national security (Dz.U. from 2022 item 835) and Article 5k(1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.07.2014, p. 1, as amended), the Contractor submits: a) a declaration of the absence of grounds for exclusion from the procedure – completed and signed appropriately by the person (persons) authorised to represent the Contractor. The relevant declaration, the Contractor submits in the form of a single document, which is Annex 4 to the Specification (form JEDZ), b) a declaration that the Contractor is not subject to exclusion from the procedure under Article 7(1) of the Act of 13 April 2022 on special solutions to counter the support for aggression against Ukraine and serving to protect national security (Dz.U. from 2022 item 835) and is not subject to a ban on awarding or further executing any public contracts under Article 5k(1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229 of 31.07.2014, p. 1, as amended) – completed and signed appropriately by the person (persons) authorised to represent the Contractor - Annex 2 to the Specification.
