Description

The subject of the contract is the supply and installation of two walk-in climate chambers for IHAR-PIB, Branch in Poznań. The scope of the contract includes delivery to the Contracting Authority's premises, transport including unloading, installation (assembly), connection, commissioning (the product must be ready for operation without the need to purchase additional equipment or software), load (validation) testing, and the provision of necessary documentation and training of the Contracting Authority's personnel in its operation and maintenance (max. 6 employees). 2. A detailed description of the subject of the contract is contained in the Subject of the Contract (Annex No. 1 to SWZ). 3. The procedure is conducted in the form of an open tender, in accordance with Article 132 of the Act of 11 September 2019 on Public Procurement (i.e. Journal of Laws of 2024, item 1320 as amended) hereinafter referred to as the "Act" or "Pzp", with an estimated value equal to or exceeding the "EU threshold" within the meaning of Article 3 of the Act. 4. The contract to which this procedure relates has not been divided into lots. Dividing the subject of the contract into lots would be unjustified for technical, organisational and purposeful reasons. The Contracting Authority does not allow the submission of partial offers, as this is not justified due to the specifics of the delivery implementation. Due to the need to coordinate the scope of the contract in a very short implementation time, dividing the contract into lots would threaten the generation of excessive organisational and technical difficulties. The need to coordinate the actions of different Contractors implementing the individual parts of the contract could seriously threaten the proper execution of the contract. The non-division of the contract into lots was therefore dictated by technical, organisational and the nature of the subject of the contract. Any division of the contract into lots would not increase competitiveness in the sector of small and medium-sized enterprises – the scope of the contract is typical, enabling the submission of offers by Contractors from the group of small or medium-sized enterprises. In accordance with the content of reason 78 of the preamble to Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement, repealing Directive 2004/18/EC (OJ EU L 94, 28.3.2014, p. 65 as amended), the contracting entity should have the obligation to consider the appropriateness of dividing contracts into lots, while retaining the freedom to make autonomous decisions on any basis it deems appropriate, not subject to administrative or judicial supervision. 5. If, when describing the subject of the contract, the Contracting Authority refers to standards, technical assessments, technical specifications and technical reference systems, as mentioned in Article 101(2) and (3) of the Pzp, equivalent solutions are allowed. Each phrase in the SWZ referring to standards, technical assessments, technical specifications and technical reference systems, should be read with the accompanying phrase "or equivalent". 6. In cases where the subject of the contract description contains indications of trademarks, patents or origin, they should be understood in accordance with Article 99(5)-(6) of the Pzp, that this is justified by the specificity of the subject of the contract and the Contracting Authority cannot describe the subject of the contract using sufficiently precise terms. In such circumstances, the Contracting Authority allows the possibility of submitting equivalent solutions in the offer, indicating that the minimum requirements that equivalent solutions must meet are requirements (functionalities) no worse than the parameters (functionalities) indicated in the Subject of the Contract. 7. A Contractor who refers to equivalent solutions described by the Contracting Authority is obliged to indicate in the offer which positions of the offer contain equivalent solutions along with their description or standards and to prove that the equivalent solutions offered by it meet the requirements specified by the Contracting Authority, in particular by means of substantive evidence. 8. The Contracting Authority does not allow the submission of alternative offers. 9. The Contracting Authority does not envisage the conclusion of a framework agreement. 10. The Contracting Authority does not envisage the selection of an offer with the use of an electronic auction. 11. The Contracting Authority does not envisage the return of participation costs in the procedure with the reservation of Article 261 of the Pzp. 12. The Contracting Authority does not envisage requirements, as referred to in Article 96(1) of the Pzp. 13. The Contracting Authority does not allow the submission of offers in the form of electronic catalogues or the attachment of electronic catalogues to the offer. 14. The Contracting Authority does not envisage the possibility of granting contracts, as referred to in Article 214(1)(8) of the Pzp. 15. The Contracting Authority, pursuant to Article 257(1) of the Pzp, envisages the possibility of invalidating the procedure for granting a contract if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. 16. Source of financing: The contract is covered by non-repayable support from the development plan in connection with the implementation of the project to expand the public analytical-laboratory and research infrastructure as part of the investment A2.4.1 Investments in the expansion of research potential, in the scope: support for investments in the public analytical-laboratory infrastructure in the plant breeding sector of institutes supervised by the Minister of Agriculture and Rural Development within the framework of the call for proposals – call number: KPOD.01.19-IP.04-003/23 for the project entitled "Modernisation of the research laboratory for the needs of oilseed plant breeding".
