Germany – Pharmaceutical products – Abschluss einer nicht-exklusiven Rabattvereinbarung nach § 130a Abs. 8 SGB V zum Wirkstoff Testosteron (ausschl. Testosteron enantat), f. d. Z. 01.07.26 - 30.06.28 (zzgl. V.-Option 1x12 Mon)

Section 130a, paragraph 8, of the German Social Code (SGB V) allows health insurance companies and pharmaceutical companies to conclude framework discount contracts for medicines to be dispensed at the expense of the statutory health insurance funds. With regard to the relevant legal provisions for the award of public contracts, the DAK-Gesundheit regularly conducts substance-related, formal tendering procedures in accordance with the provisions of Part 4 of the German Act Against Restraints of Competition (GWB).

For medicines to be specified by the bidder in Annex 2 to the contract, containing the aforementioned substance Testosterone (exclusively Testosterone enanthate), ATC G03BA03, the DAK-Gesundheit intends to conclude medicine discount contracts with as many interested pharmaceutical companies as possible until new medicine discount contracts come into force. A discount contract in accordance with the approval model for the aforementioned substance will come into effect for the first time on 01.07.2026 and will end on 30.06.2028 (plus extension option 1x12 months). It will automatically end, regardless of this, with the coming into force of the exclusive contract.
