Poland – Dairy products – Dostawy produktów mleczarskich

1. The subject of the order are successive deliveries of dairy products to the Police School in Piła. 2. A detailed description of the subject of the order and the full list of the assortment being the subject of the deliveries as well as the estimated quantity of the ordered products are given in the Product-Quantity Specification, which is Annex No. 2 to the SWZ. This annex is part of the offer, and therefore must be submitted in the form provided for the offer. 3. The quantities given are estimated quantities and do not oblige the Buyer to purchase the products in these quantities. 4. The Buyer reserves the right to not realise the subject of the order up to 50% of the total gross remuneration. For the non-realisation of part of the order, no financial or legal claims are due to the Contractor. 5. The Buyer does not divide the order into parts. Therefore, the Buyer does not allow partial offers to be submitted, as mentioned in art. 7 point 15 of the Pzp Act. 6. The delivery, unloading and bringing in of the subject of the order will be carried out at the cost of the Contractor, included in the price of the products covered by the public procurement contract. 7. The delivery of the subject of the order will be carried out by means of transport of the Contractor permitted to transport food. 8. The Contractor is obliged to have an up-to-date certificate of registration in the register of establishments subject to official control by the competent authorities - in accordance with the Act of 25 August 2006 on food and feed safety (i.e. Dz. U. from 2023, item 1448) or an up-to-date administrative decision on registration in the register of establishments or on the approval of the establishment issued by the district veterinarian together with the assigned identification number in accordance with art. 21 para. 4 of the Act of 16 December 2005 on animal by-products (i.e. Dz. U. from 2023, item 872 with later amendments). The Contractor must be under constant supervision by the competent authorities. 9. The offered products must meet the requirements listed in the applicable legal provisions on the production and trade of food. Each product must be produced and introduced into circulation in accordance with the requirements of the HACCP system. 10. The Contractor is obliged to realise the order on the principles and conditions described in the Draft Contract Terms, which is Annex No. 3 to the SWZ. 11. The order will be realised successively: from 1 March 2027 to 31 December 2027 or until the earlier exhaustion of the total gross remuneration resulting from the contract. 12. The Buyer specifies the deadline for the execution of the order by date, since these are deliveries that recur periodically. Indicating a specific date for the execution of the order will allow to maintain the continuity of deliveries. 13. In connection with art. 455 para. 1 point 1 of the Pzp Act, the Buyer provides for the possibility of extending the deadline for the implementation of the contract by 2 months after the deadline specified in the contract, in the event that the funds resulting from the concluded contract are not exhausted within the deadline specified in para. 1 and a contract resulting from the next procedure is not signed. In order to introduce the above change, an annex to the contract will be concluded. 14. The delivery of goods will take place daily 5 times a week from Monday to Friday from 10:00 to 13:00. In justified cases, the Buyer may require the delivery of goods also on Saturdays from 10:00 to 13:00. In exceptional situations, the delivery hours resulting from the change in the schedule of the trainees' classes may be changed. 15. Place of execution of the order: food warehouse of the Food Section of the Police School in Piła, Plac Staszica 3, 64-920 Piła.
