The process of public procurement for the award of this contract will be carried out using the professional resources available at the "Sf. Ioan" Children's Emergency Clinical Hospital, Galati. The completion of the award procedure through the conclusion of the framework agreement is subject to the following condition:

Suspensive clause: The procedure for awarding the framework agreement has been initiated under the present suspensive clause, in the sense that:

- The conclusion of the subsequent contract is conditional upon the obtaining/approval of financing from budgetary funds [state/local budget, own funds] and/or non-repayable European funds, the signing of the contract being possible only in the situation where the provisions regarding the commitment of expenditures from the budgets that fall under the scope of the legislation on public finances are respected.

- In the event that, for whatever reason, the financing is not approved so that the contracting authority has the necessary funds, the contracting authority will apply the provisions of art. 212 para. (1) lit. c) point a) of Law no. 98/2016, making it impossible to conclude the public procurement contract.

The maximum period for which the suspensive clause operates is 36 months.
