Additional information on the negotiated procedure with a prior selection competition

1. Conditions for the selection competition ("application or participation request")

The basis for the selection competition are the "General application conditions for the implementation of the selection competition as part of a negotiated procedure with a prior selection competition" published on the eVergabe platform (see internet address under 5.1.11 and 5.1.12 "Communication" of the contract notice published in the EU Official Journal) as of 02/2025 and "260218 HPT LFI Questions and Answers TNW Pipeline Planning". To participate in the selection competition ("application or participation request"), the applicant uploads the participation documents provided by bayernets via the eVergabe platform and completed by the applicant in accordance with the following rules on the eVergabe platform. The applicant must use only the participation documents/forms provided via the eVergabe platform for their application. Any changes to the participation documents provided via the eVergabe platform are prohibited and may result in exclusion from the procurement procedure. Documents not requested by bayernets and additionally attached to the application will not be considered. The participation documents must be completed fully and truthfully by the applicant. The declarations and evidence required in the participation documents and the contract notice must be submitted. Unless otherwise stated in the contract notice, the participation documents provided via the eVergabe platform, together with any other declarations and evidence, must be signed in writing, scanned, and uploaded completely in the eVergabe platform within the application deadline (cut-off date) specified in the contract notice.

2. Conditions for tender submission ("tender")

The basis for the tender submission are the "Tender conditions for the implementation of the negotiated procedure following a prior selection competition and execution conditions for the pipeline planning tender HyPipe two – New construction of hydrogen transport Forchheim-Irsching", as of 11/2023. To conduct the negotiated procedure, the bidders are invited to submit a tender on the eVergabe platform of the service provider commissioned by bayernets for this purpose (hereinafter "eVergabe platform"). The documents required for the tender submission were already made available for download via the eVergabe platform at the time of the contract notice, "Tender documents (with obligation to return for electronic tender submission)" and "Tender documents (general)", unless they were made available in another way for security reasons; bayernets will provide any additionally required documents on the eVergabe platform for download if necessary (hereinafter collectively referred to as "tender documents"). Based on the tender documents, the bidder prepares a tender and completes the tender documents to be completed. The tender, together with the completed tender documents and a cover letter to bayernets, in which reference must be made to the invitation from bayernets to submit a tender and the contract notice of the corresponding selection competition in the EU Official Journal mentioned there, must be uploaded by the bidder in the eVergabe platform.
