Description

The subject of the contract is the supply of teleinformatics equipment and software, including:

1.1. Rack servers (dual-processor, 1U) intended for expanding the data processing centre environment of the Buyer, in the quantity of 5 units;

1.2. Fibre Channel switches intended for expanding the Buyer's SAN network, in the quantity of 2 units;

1.3. Server virtualisation software (hypervisor) with a central management console and a set of licences covering all physical cores/processors of all 5 servers.

2. The detailed description of the subject of the contract has been defined in SWZ Part III Description of the subject of the contract and in Part IV SWZ (PPU) and the annexes to the SWZ.

3. The Buyer does not envisage a local view.

4. The Buyer does not allow the possibility of submitting partial offers.

5. The Buyer does not allow the possibility of submitting alternative offers.

6. The Buyer does not envisage the possibility of applying the right of option.

7. The Buyer does not require the submission of subject-related evidential means with the offer.

8. The Buyer does not envisage the possibility of supplementing the subject-related evidential means on the basis of Article 107(2) of the Pzp Act.

9. The Buyer does not envisage holding a pre-offer meeting with the Contractors.

10. The Buyer allows the participation of subcontractors in the implementation of the contract.

10.1. In the event of subcontractors participating in the implementation of the contract, the Buyer, in accordance with Article 462(2) of the Pzp Act, requires the Contractor to indicate the parts of the contract whose execution the Contractor intends to entrust to subcontractors, and for the Contractor to provide the names of the subcontractor companies (if known).

10.2. Entrusting the execution of parts of the contract to subcontractors does not release the Contractor from responsibility for the proper execution of the contract.

11. The Buyer does not stipulate in the description of the subject of the contract the accessibility for disabled persons or the design for all users.

12. The Buyer does not stipulate the obligation for the Contractor to personally perform key tasks related to the implementation of the subject of the contract.

13. The Buyer does not stipulate the obligation for individual Contractors jointly applying for the award of the contract to personally perform key tasks related to the implementation of the subject of the contract.

14. The Buyer does not set a requirement in terms of employment by the Contractor of persons referred to in Article 96(2)(2) of the Pzp Act.

15. The Buyer does not specify the requirement for the employment by the Contractor or subcontractor of persons on the basis of an employment contract, as referred to in Article 95(1) of the Pzp Act.

16. The Buyer does not stipulate requirements related to the implementation of the contract, as referred to in Article 96(1) of the Pzp Act.

17. The Buyer does not stipulate requirements related to the implementation of the Subject of the Contract, as referred to in Article 101(1) of the Pzp Act.

18. RODO - Information Clause contained in the SWZ.

19. The Buyer does not envisage that advance payments will be made in the subject procedure for the execution of the contract.

20. The Buyer does not envisage the reimbursement of participation costs, except in the event of a situation as referred to in Article 261 of the Pzp Act.

21. The Buyer does not envisage the possibility of awarding contracts, as referred to in Article 214(1)(8) of the Pzp Act.

22. The Buyer does not envisage the holding of an electronic auction, as referred to in Articles 227-238 of the Pzp Act.

23. The deadlines for the implementation of the individual obligations of the Contractor, which make up the subject of the contract, have been defined in the Draft Contract Terms constituting Part IV of the SWZ and in the Description of the subject of the contract indicated in Part III of the SWZ and the annexes to the SWZ.

24. The Buyer does not require the Contractors to submit objections.

25. The Contractor is obliged to provide security for the proper execution of the contract in the amount constituting: 3% of the maximum value of the Buyer's obligation arising from the Contract in accordance with Article 452(2) of the Pzp Act.
