Description
Rebuilding with an extension and expansion of building no. 2 along with the link, in which the Cardiology Clinic and the Internal Diseases Clinic are located, in the design and build system - task no. 91837 – stage I construction of the Link according to the terms set out in the SWZ. Justification for the exclusive admission of 3D modular technology with a steel structure
a) The Contracting Authority indicates that in the two previous public procurement procedures, announced from 6 November 2025, in which the implementation of the investment in traditional technology was allowed with the simultaneous admission of modular solutions, no successful contractor was selected, which resulted in the need to invalidate them. The above caused a significant loss of time, and the further repetition of the previous model of procedure would be associated with a high risk of further delays, which the Contracting Authority – due to the nature of the investment – cannot accept.
b) Due to the need for urgent implementation of the investment intention, the Contracting Authority is obliged to accept such technological solutions that will guarantee the maximum reduction in the implementation time of the works and the limitation of the executors' risks. The analysis of the available technologies showed that only the 3D modular technology with a steel structure provides the possibility of implementing the investment within the required, non-extendable deadline, while maintaining a high level of execution quality.
c) It should also be emphasized that the investment is being implemented under particularly difficult organizational and technical conditions. The investment site is located in an area with limited spatial accessibility, preventing the organization of a classic construction site and the carrying out of intensive earthworks and assembly works characteristic of traditional technology. At the same time, the object is an active hospital functioning continuously, without the possibility of temporary exclusion of its parts from use or relocation of patients. As a consequence, construction works must be carried out in a way that minimizes interference with the ongoing medical activities, including without generating excessive noise, vibrations, or dust, as well as without long-term occupation of the usable space.
d) In addition, the object is under conservation protection, which imposes on the Contracting Authority the obligation to carry out works under increased formal and technical conditions, with a limitation of the possibility of interfering with the existing building substance and the environment.
e) In light of the above, the 3D modular technology with a steel structure is the only solution that meets all the requirements of the Contracting Authority, in particular through: • significant reduction of implementation time thanks to the prefabrication of elements outside the investment area, • limitation of "wet" works and site works, • minimization of inconvenience for the functioning hospital (noise, vibrations, dust), • reduction of the need for construction support and storage area, • possibility of carrying out assembly in short, precisely planned stages. • At the same time, modular technology provides the Contracting Authority with additional benefits in the long term, including flexibility in terms of future expansion, rebuilding or relocation of objects, as well as easier modernization of infrastructure.
f) Consequently, the limitation of the admissible technology to 3D modular with a steel structure has an objective and proportional justification in the specificity of the subject of the contract, the conditions of its implementation and the urgent need to achieve the investment goal without further delays.
g) A detailed analysis of the choice of technology for the execution of the object is Annex No. 1a to OPZ 5.3. The detailed description and scope of the subject of the contract are specified in the SWZ and in ANNEX No. 1 to this SWZ.
5.4 The Contractor shall prepare the design documentation within the scope in accordance with the Regulation of the Minister of Development and Technology of 20 December 2021 on the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works and the functional-use program (Journal of Laws of 2021, item 2454) with regard to the requirements indicated in the SWZ, in particular in points 5.6-5.18 of the SWZ.
5.5 The scope of the contract includes all the actions of the Contractor necessary to execute the subject of the contract properly, in accordance with the applicable legal provisions and recommendations of the competent authorities.
5.6 The construction works must be carried out in accordance with the relevant regulations, in particular in accordance with the applicable regulations, including, among others, the Act of 7 July 1994 on Construction Law, the Regulation of the Minister of Infrastructure of 6 February 2003 on safety and hygiene at work during the performance of construction works, technical and construction regulations, applicable standards and documentation specified in the SWZ.
5.7 The Contractor must offer at least 36 months (but not longer than 60 months) - subject to the criterion of evaluating the offer - a warranty period for the works carried out and the materials/equipment installed/built-in, supplied devices and installations, counted from the date of acceptance of the entire order.
5.8 The Contracting Authority requires the employment of employees by the Contractor and subcontractors on the basis of an employment contract, directed to the execution of the order (the Contracting Authority has in mind all physical workers, directly involved in the process of performing general construction works). This requirement does not apply to persons managing construction/works, drivers, and specialists performing work within the scope of their own business activity.
5.9 NOTICE!!! Due to the performance of construction works on the territory of the operating Hospital, the organization of works must be agreed and accepted in writing by the Contracting Authority and must not excessively hinder the activity of the Hospital.
