The subject of the contract is the execution of water supply and sewerage works - canals, gas and other works that are impossible to plan in the resources of the Municipality of Siemianowice Śląskie. The detailed description of the subject of the contract includes the Scope of Works, STWiORB – Supplement No. 3 to SWZ. In the event of the use of any type of work indicated in the cost estimate items while simultaneously not using another type of work, the Contracting Authority allows the change of the estimated quantities indicated in the tender cost estimate by the Contractor by changing the quantity within the individual types of works (cost estimate items), while maintaining the gross unit prices (specified in the tender cost estimate) and not exceeding the maximum gross contract value specified in the submitted tender and the concluded contract. The change made by the Contracting Authority will not constitute a basis for the claims of the Contractor. The Contracting Authority informs that during the contract period, unforeseen works may occur, in which case the Contractor will apply rates and surcharges in accordance with the tender cost estimate, and the price of materials (excluding purchase costs) and equipment may not exceed the average values of “SEKOCENBUD” from the previous quarter. At the request of the Contracting Authority, the Contractor is obliged to provide invoices for the purchased materials. The Contractor will provide the Contracting Authority with a quality guarantee for the works that are the subject of the contract, for a period of 60 months, counting from the day following the day of the protocol acceptance without reservations of the entire subject of the contract, executed under the conditions specified in the Specyfikacja Warunków Zamówienia.
