Description
The Contracting Authority will apply the procedure referred to in Article 139(1) of the Public Procurement Law (i.e. the so-called reverse procedure). In the procedure, based on Article 139(1) of the Public Procurement Law, the Contracting Authority will first carry out an examination and evaluation of the submitted tenders, and then carry out the qualification of the Contractor whose tender was highest rated, in terms of the absence of grounds for exclusion, as referred to in Chapter VI of the SWZ, and compliance with the conditions for participation in the procedure, described in Chapter VII of the SWZ.
2. The Contractor is obliged to submit with the Tender the subject-matter evidential means as well as declarations of non-exclusion and compliance with the conditions for participation in the procedure in the form of a single European procurement document (EPD).
3. The Contractor may use the EPD submitted in a separate procedure for the award of a contract, if he confirms that the information contained therein remains correct.
4. In the case of joint bidding for a contract by Contractors, the EPD is submitted by each of the Contractors. These declarations confirm the absence of grounds for exclusion and compliance with the conditions for participation in the procedure to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure.
5. If the contractor relies on the resources of other entities in order to demonstrate compliance with the conditions for participation and in order to demonstrate the absence of grounds for exclusion in the procedure, the EPD relating to those entities is submitted to the extent that the contractor relies on their resources, the EPD should be completed to the extent that the contractor uses the resources of another entity and the contractor submits declarations and documents relating to the grounds for exclusion.
6. In the section "Part IV Qualification Criteria" of the EPD, the Contractor may limit himself to completing section alpha General declaration relating to all qualification criteria, in which case the contractor does not complete any of the other sections (A-D) in Part IV of the EPD.
7. In order to confirm the absence of grounds for exclusion of the Contractors from the procedure and to confirm compliance with the conditions for participation in the procedure, the Contracting Authority, within a specified period, not shorter than 10 days from the date of the invitation, will invite the contractor whose tender was highest rated, to submit subject-matter evidential means, current as of the date of their submission. 8. The procedure for the award of a contract also excludes the Contractor in respect of whom circumstances occur, as referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine.
9. In response to the Contracting Authority's invitation, the Contractor is obliged to submit subject-matter evidential means, as referred to in §2(1)(1)-2) and (6)-7) of the regulation of the MRPiT of 23.12.2020 on subject-matter evidential means and other documents or declarations which the Contracting Authority may require from the Contractor in the context of the grounds for exclusion from the procedure indicated by the Contracting Authority in this notice.
10. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, it is obliged to submit subject-matter evidential means, as referred to in §4 of the regulation, referred to in point 9 above.
11. If the Contractor relies on the capabilities or situation of entities providing resources, it is obliged to submit subject-matter evidential means relating to those entities in accordance with §5 of the regulation, referred to in point 7 above.
12. The Contracting Authority does not envisage the possibility of awarding contracts, as referred to in Article 214(1)(7) of the Public Procurement Law.
13. The Contracting Authority envisages the possibility of invalidating the procedure for the award of a contract on the basis of Article 257 of the Public Procurement Law.
14. For the subject-matter contract, the Contracting Authority did not carry out preliminary market consultations before initiating the procedure.
